Corruption is a problem that plagues the countries of the world.China is an ancient civilization with a history of 5,000 years.The issue of corruption is also a stubborn disease left over from history.In accordance with the strategic plan of comprehensively advancing the rule of law,comprehensively administering the party strictly,and comprehensively deepening reforms,the Party Central Committee made a major decision on the reform of the state’s supervisory system.The reform of the national supervision system is of great importance and must be carried out with caution.Therefore,reform pilot projects were first carried out in Beijing,Shanxi and Zhejiang.After more than a year of practical experience,the first meeting of the 13th National People’s Congress was finally held.Through the Constitutional Amendment of the People’s Republic of China and the Supervision Law of the People’s Republic of China,the state’s supervisory power was established and the constitutional status of the supervisory committee was clarified.The establishment of the state’s supervisory power is conducive to the integration of anti-corruption resources and the effectiveness of state supervision.However,there is a great controversy in the academic world regarding the definition of the nature of the state’s supervisory power and the legal position of the supervisory committee.The establishent of the state supervision power is to use the "power to restrict power" model to protect the basic rights of citizens,so as to achieve the ultimate goal of realizing the national governance capacity and modernization of the governance system.The basic functions of the state’s supervisory power can be summarized as:the adjustment function of the state power structure,the guarantee function of the citizens’ basic rights,and the maintenance function of the state credit and in,ternational image.As a new power that combines multiple anti-corruption forces,the state’s supervisory power has a strong and concentrated internal force.The standardization of its operation is directly related to the ultimate effectiveness of the supervision work.Therefore,the operation of the supervisory power must conform to the Constitution and the law.Always implemented under the rule of law.The state supervision power has expanded the scope of supervision and supervision.In order to prevent the abuse of power,it must be strictly supervised and restricted.First of all,it is necessary to establish an internal control mechanism covering the entire supervisory authority,and achieve self-monitoring through internal supervision and control,followed by the introduction of external supervision mech,anisms including party supervision,people’s Congress supervision,judicial supervision,and social supervision.Internal and external monitoring mechanisms.With the continuous advancement of the state supervision system reform,China’s anti-corruption struggle has entered the stage of comprehensive rule of law,and the anti-corruption struggle has shown an overwhelming trend.However,the overwhelming situation is not equal to the overwhelming victory.China’s anti-corruption situation is still grim.This paper will focus on the establishment of supervision power in China’s supervision system reform and how to supervise and restrict the state supervision power.
