The Research On The Balance Of International Protection Of Network Copyright

This article is based on the basic contradiction of copyright's territoriality,exclusiveness with the sharing and openness of knowledge,the conflict with network's borderlessness and virtuality.The objective reality that the international protection of copyright break the regional protection of copyright protection is regarded as the realistic basis of the international copyright protection of copyright.The balance of interests is the fundamental value pursuit of the international protection of copyright.This article recognize the subversive impact of digital technology on traditional copyright and the importance of Internet Services Providers(ISPs)is recognized.This article study and analyze the reason of the unbalance of network copyrights is based on the current situation of the imbalance of interests in the international protection of network copyrights,and puts forward renewing the theory of Copyright,clarifying "Originality","Idea" and "Expression".Building a multiple Network Protection System;Defining the ISP's legal status and his rights and obligations;Regarding the control of network communication rights as the main means to protect Network Copyright;and construct a new network copyright protection international order to deal with the impact of Internet digital technology on the traditional balance of copyright interests.It can promote the establishment and improvement of the international Network Copyright Protection System,realize the balance between the author's spiritual interests and material interests,balance the interests of copyright owners and the public,ISPs;and balance the interests of developed countries and developing countries.
