Research On Public Participation In Administrative Decision-making

Public participation is one of the legal procedures of major administrative decisions,and is also the most extrinsic procedure.Its supervision and restriction on administrative decisions is especially obvious.However,the procedure system was empty and disorderly dilemma in the administrative decision-making practice,the related theoretical research lags behind and affects the effective functioning of the system of public participation.In the long run,this also affects the fate of the new democratic system in Our Country.Therefore,how to enhance the effectiveness and the orderliness of public participation in administrative decision making through theoretical innovation and practical innovation has become an important theoretical and practical proposition for the current rule of law and the construction of the rule of law government.From the perspective of practical law,this paper analyzes the public participation in administrative decision making from the perspective of administrative law.The main contents include th ree parts: theoretical analysis,practical difficulties,legal causes and countermeasures of public participation in administrative decision-making.In the theory part,it mainly discusses the concept of public participation in administrative decision-making and its legitimacy.In the practical difficulties part,the two difficulties of public participation in "useless" and " unordered " are mainly analyzed combined with cases,and the legal reasons for the dilemma are analyzed.In the rule of law strate gy,this paper puts forward four basic principles of public participation in administrative decision-making in our country: participation with participation,limited participation,orderly participation and effective participation.Under the guidance of ba sic principles,I will put forwardfrom six aspects: the awareness of the rule of law,the legal system,the legal system of the main body,the legal system of the procedure,the legal system of the safeguards and the relief,some specific measures are put forward.
