The Perfection Of The Record System Of The Whole Process Of Administrative Law Enforcement

As a new legal system,the whole process record system of administrative law enforcement is of great significance for supervising administrative law enforcement,ensuring public's right to know,reducing litigation risk and building a government under the rule of law.Although there is no relevant law in the country,32 places and departments have been identified as a pilot.Nowadays,the whole process record system of administrative law enforcement is an important system for standardizing administrative enforcement activities,and has been launched in many places and departments.This paper combs the practice of the whole process of administrative law enforcement from the aspects of connotation,principle,significance,main body,content,way,preservation,use and legal responsibility,and puts forward some suggestions for further discussion.In the subject of the record,the person who has the qualification of law enforcement in the law enforcement unit must have the subject qualification;the assistant record of law enforcement assistants must be signed by the law enforcement officers;the administrative law enforcement personnel who do not participate in the specific law enforcement activities and the litigants and the outsiders are not the subject of the whole process of the administrative law enforcement.Writing and image records are commonly used for recording,but online records should also be used as an independent way of recording.In the use of records,administrative law enforcement personnel,relative persons and outsiders can be used,but the relative persons and the outsiders are limited.Besides,a way of creating law enforcement record platform is also put forward.In the legal responsibility of the law enforcement personnel,it should clear its responsibility and establish the assessment system.It is expected that my proposals will help the legislation of the whole process record system of administrative law enforcement in the future.
