Research On The Recording System Of The Whole Process Of Administrative Law Enforcement

At present,our country is in the period of social transformation.The problems of administrative law enforcement,such as unrecorded law enforcement process,non-procedural law enforcement and uncivilized law enforcement,are prominent.In order to improve the quality of administrative law enforcement and the level of law enforcement of administrative law enforcement officials,the state has put forward the requirement of establishing the record system of the whole process of administrative law enforcement.In view of this,this paper makes an in-depth study.Firstly,it focuses on the concept of the record system of the whole process of administrative law enforcement,and discusses its corresponding connotation by consulting different documents and corresponding reference documents.Secondly,it discusses the purpose and significance of the establishment of the system.First,it standardizes the administrative law enforcement behavior and guarantees the legitimate rights and interests of citizens,legal persons and other organizations;second,it prevents and resolves social contradictions and reduces unnecessary administrative disputes;third,it focuses on judicial reform and safeguards judicial fairness.Then,combing the whole process record of law enforcement with the process of administrative law enforcement,and taking administrative law enforcement as an example,combing each link one by one by combining with relevant law enforcement documents,from the source of the case to the filing of the case,showing the whole process record of administrative law enforcement in a panoramic way;furthermore,establishing the whole process record of administrative law enforcement.Discusses the problems faced in the implementation of the record system of the whole process of administrative law enforcement,and makes a series of analyses on the issue of docking the information of law enforcement as government information to accept the application for publicity and as evidence of administrative litigation.Among them,it focuses on whether and how to make the record information of the whole process of law enforcement publicly available and act as a lawsuit.Finally,according to the current situation of our country,this paper puts forward some thoughts on the record system of the whole process of administrative law enforcement from the aspects of strengthening legislation,speeding up the implementation of pilot work,strengthening the construction of law enforcement informatization and strengthening the standardization of law enforcement training.
