Open Space And Harmonious Community:A Legal Study On The Publicity Of Community Space

At present,China's economy is fast development,urbanization is also in full swing.Therefore,China's urban construction in the process of modernization is facing tremendous changes.In early 2016,the State Council issued a statement that the future of urban residential buildings in principle no longer closed,this opinion came out,immediately aroused widespread concern in the society,because our country has always been based on the closed residential area,the open block system is still a relatively strange concept,the lack of practical experience and supporting system norms.The study of block system is a new interdisciplinary subject,which involves the theoretical knowledge of architecture,sociology,law and so on.The spatial layout of urban communities is influenced by traditional culture,political ideas and customs,different period and different regions often have their own characteristics.Therefore,block system construction is a comprehensive problem,in order to solve these problems,we should study the influence of traditional culture on the concept of space,and the conflicts of interest in the block system,finally,choice a legal channel in line with the current situation of China's building blocks.In this process,we should pay attention to the concept of spatial justice and the socialization of property rights,as a support,to demonstrate the rationality and legitimacy of community space.In our tradition culture,there are a lot of spatial concepts,which are politicized and used by the ruling class to exercise power.Under the impetus of this concept of space and political culture,the space of people's living environment in China is changing from time to time.In modern time,with the improvement of people's material products,the requirement of their living environment have been greatly improved,and the consciousness of space rights has also been enhanced.Various space theories have emerged,among them,spatial justice is a kind of spatial form and spatial relation that conforms to ethical,and it can be use as the basic theory for people to construct community space,however,in the process of space construction,it should be restricted by law,and the rights of all parties should be dynamically balanced,therefore,we must follow the legal concept of socialization of property rights,under this premise to legal regulation on the construction of open type residential areas.
