Study On The Legal Liability Of Administrative Dishonesty

Under the general background of the state council vigorously promote the construction of administrative integrity.From the perspective of administrative rule of law,the author studies and demonstrates the construction of administrative integrity in theory,referring to relevant legislative experience at home and abroad,and combining with China's specific national conditions,to explore the legal framework of our country to establish a set of legal responsibility for breach of trust in administrative affairs.This paper takes the legal liability of administrative affair breach of trust as the Angle of view,because the legal liability is of great significance in the legal standard,and it is the guarantee for the legal standard to realize its legal value.Based on the theory,the author deeply studies the principle of government credit,which lays a theoretical foundation for the legitimacy of the legal responsibility of administrative dishonesty.Based on the analysis of the current situation and reasons of the government affair breach in our country,the necessity of establishing a perfect legal liability mechanism for administrative dishonesty is expounded.On this basis,combined with the analysis method of legal liability,this paper discusses the constitutive elements of legal liability for administrative dishonesty,and establishes the essential elements and reference standards of legal liability for administrative dishonesty.On the premise of this theory and reality analysis,the author expatiates on the idea of constructing the legal liability mechanism of administrative dishonesty under the current situation of China.In this paper,the author focuses on the construction of the legal governance of administrative integrity and provides a possible thinking for the construction of the legal responsibility mechanism of government credibility breach.Under such a train of thought,although I try to refine and build on the details,many specific theories are only dabbled and have not been well reasoned.All of these need to be further improved and perfected by myself and my colleagues in academia.
