Study On Problems And Countermeasures Of People's Mediation Work

People's mediation refers to the people's mediation committee convincing parties to reach a mediation agreement voluntarily on the basis of equal consultation and to resolve civil disputes through persuasion,counseling and other methods.With the prosperity and development of China's economy,social contradictions and disputes have many new features such as complexity,diversification,etc.Studying people's mediation work is of great significance in quelling contradictions and disputes,safeguarding public interests and maintaining social order.This paper expounds the concept,nature and function of people's mediation,sort out the relevant policies and laws of the people's mediation,recalls the historical process of the development of the people's mediation system,analyzes the problems existing in the people's mediation work at the present stage,including the people's mediation work is not taken seriously,personnel mediation is lack of funds and personnel,the people's mediators tend to violate the principle of neutrality in their work,the mediating environmental disputes in rural areas is difficult,people's mediation agreements have some ambiguous texts,content violations of laws and regulations,etc,as well as the application of the convergence process between the people's mediation and litigation dispute resolution is subjectively influenced.The author propeses that improving the sense of identity of people's mediation work,improving relevant laws and regulations related to people's mediation,improving the professionalism of the people's mediators,and proposing to improve the people's mediation and court docking system,especially offering the idea of using good governance theory to combine people's mediation with the work of street office and neighborhood committees to activate the government's body and make people's mediation maximize the role of maintaining social stability.
