Study On The Implementation Effect Of Rural Dispute Mediation Mechanism

Nowadays,the legal consciousness of the masses is increasing.They were more and more aware of taking up the weapon of law to exercise their powers and duties,but they have little knowledge of the law and seem to know nothing about national policies.They only know how to safeguard their rights and interests,but they are not clear about how to safeguard them.When they can not solve problems privately,contradictions will arise,and then blind petitions will arise,which will lead to new problems.Types of disputes.Therefore,in recent years,the mediation mechanism on rural contradictions and disputes has become more and more perfect,but in the process of implementation,there will always be such problems as: the responsibility of dispute mediation between the main body of mutual prevarication,the weakening of the people's mediator team,Villagers' Understanding of Policy and Its Implementation,resulting in the implementation of the current rural dispute mediation mechanism is not ideal.When the rural dispute resolution mechanism fails to achieve the purpose of resolving disputes,it increases the difficulty for grass-roots cadres to solve contradictions and disputes,thus deepening the contradictions with the masses,which is a thorny problem in the process of rural dispute mediation.It is very important to achieve the goal of harmonious society,solve contradictions and disputes and maintain social stability.We hope to improve the implementation effect of rural dispute mediation mechanism by improving the mechanism,strengthening the communication between cadres and masses,strengthening the competence quality education of grass-roots cadres,and paying attention to the legal and ideological and cultural education of villagers.This article will elaborate the implementation effect of rural dispute resolution mechanism from the aspects of historical development,research experience,development status,case analysis and so on.This paper tries to describe the problems encountered by the current mechanism in the implementation of dispute resolution,find out the reasons for these problems,and put forward countermeasures to improve the implementation effect of the rural dispute mediation mechanism.The theoretical framework of this paper mainly uses the theory of legal pluralism and dispute mediation.The research methods adopted in this paper are field investigation and case analysis.The article mainly elaborates through six parts: Chapter 1,introduction,combined with the background of this study,emphasizes the purpose and significance of the study,analyses and summarizes the theoretical views of scholars at home and abroad,and studies the current situation at home and abroad.The second chapter is to put forward the theoretical basis.The third chapter elaborates the implementation status of rural dispute mediation mechanism.Chapter IV analyses the problems encountered in the implementation of rural dispute mediation mechanism.The fifth chapter analyses the reasons for the problems.Chapter 6explains how to improve the implementation effect of rural dispute mediation mechanism by putting forward solutions.Finally,the conclusion is drawn.In a word,this article advocates that on the premise of abiding by the value orientation of modern justice,we should closely combine the actual situation of modern rural disputes with the implementation of existing dispute resolution mechanisms,and improve the implementation effect of rural dispute mediation mechanisms through various ways.In order to better meet the requirements of dispute resolution and social stability in rural areas.
