Study On The Legislation Of Wetland Protection In Gansu Province

Wetland is a complex whole composed of soil,water resources,animals and plants and other natural elements.It plays a fundamental and key role in economic and social development and ecological civilization construction.Gansu Province,located in the hinterland of China,is rich in wetland resources,which is an important ecological barrier in Northwest China.But with the rapid development of economy and society in recent years,the rapid growth of population and the continuous expansion of urban scale,the trend of natural wetland quantity reduction,quality decline and function degradation in Gansu province continues,and the wetland ecosystem in Gansu Province is facing serious challenges and threats.Therefore,the establishment of a perfect legal system of wetland ecological protection is of great practical and historical significance to Gansu Province.In order to effectively protect wetland resources and maintain wetland ecological balance,the regulations of Gansu Province on wetland protection(hereinafter referred to as the regulations)were adopted at the seventh meeting of the Standing Committee of the provincial people's Congress on November 28,2003,and formally implemented as of February 2,2004.Its formulation and promulgation is in the leading position in the national wetland protection local legislation,which has played an important role in promoting the formation of wetland protection and wetland protection system framework in Gansu Province.However,there are five major problems in the implementation of the regulations for more than ten years,such as the inaccurate definition of wetland concept,the lagging legal concept of wetland protection,the uncoordinated wetland management system,the insufficient public participation and the lax investigation of legal responsibility,which need to be made up and improved in time.In view of this,based on the basic theory of wetland protection,using the methods of on-the-spot investigation,value analysis and normative research,aiming at the outstanding problems existing in the legislation of wetland protection in Gansu Province,this paper puts forward that "we should fully combine the actual situation of Gansu Province,clarify the concept of wetland law;take the concept of" ecological priority "as the guiding ideology of legislation;establish the coordination mechanism of wetland protection and establish the county level The above responsibilities of comprehensive management of the people's government;support and reward advanced wetland protection models,refine and strengthen the participation of the public in advance;restrict the circumstances of serious harm to wetlands,and improve the corresponding economic punishment standards as appropriate " and other specific ideas and suggestions.It aims to enrich and improve the legal theory of wetland protection in Gansu Province,and provide effective legal countermeasures and successful experience for the future local legislation of wetland protection.
