Study Of Collective Discussion In Major Administrative Decision-making

Under the background of promoting the construction of the rule of law,the executive power is characterized by the administration of law,and its operation has been developed and improved.The major administrative decision-making power it is an important link in the executive power,and has become the point of rule of law construction.The fourth plenary session of the 18 th Communist Party of China(CPC)Central Committee make “public participation,expert demonstration,risk assessment,legality review,collective discussion and decision”as five legal procedures,local governments have introduced regulations and normative documents to standardize administrative procedures to supervise and control the operation of major administrative decision-making powers.The collective discussion and decision is the last link of the five major legal procedures for major administrative decision-making procedures,and played the role of “double insurance” for supervising administrative decision-making power.This paper has five major parts.The first part is the status of the collective discussion decision of major administrative decision-making,Confirm the concept of it,defining the scope of major administrative decisions to ensures the efficiency of administrative decision-making,and analyze its legal norms and operational status from the perspective of administrative law,reveal the predicament of its existence.The second part explains the function of the collective discussion and decision;The third part explores its theoretical origins and clarifies the theoretical basis of the collective discussion decision.The fourth part proposes the improvement of the current system,and focuses on the procedural rules of the collective discussion system.The fifth part discusses the legal responsibility of the relevant subjects,the accountability is the problems to be solved for collective discussion and decision's sustainable development.This paper aims to improve the collective discussion decision system,focusing on the path of “crystallize” of collective discussion and decisions,as well as the issue of responsibility identification,we will try to establish an operational and effective collective discussion and decision system,to enhance the science and democracy of major administrative decisions and ensure the prudence and authority of administrative decision-making power.
