Since major administrative decisions are related to the people's livelihood and the public interest,they are inevitably affected by various external factors before the decision-making or in the process of decision-making.Therefore,it is very important to supervise and evaluate the decision-making after a period of implementation.necessary.The third-party assessment of major administrative decision-making is a comprehensive assessment of the content and implementation effects of major administrative decisions by independent third parties in accordance with the requirements of decision-making,combined with the requirements of economic and social development,in accordance with certain procedures,after a period of implementation of major administrative decisions.And in this way,activities to continue,adjust or abolish major administrative decisions.In August 2017,the “Provisional Regulations on Major Administrative Decision-Making Procedures” was promulgated.The regulations mainly regulate the major administrative decision-making procedures of governments at all levels in China.Article 36 stipulates that major administrative decisions can carry out third-party assessments,but lack specific procedures.At present,the rules for third-party evaluation procedures for major administrative decisions are made by local governments according to actual conditions,and there are problems such as low ranks and inconsistent content.The standardized construction of the third-party evaluation procedure for major administrative decision-making is the necessary path to ensure the orderly conduct of assessment activities,the best way to guarantee the more impartial authority of the assessment results,and the scientific democracy that guarantees the major administrative decision-making itself,and the implementation of major administration The proceduralization of decision-making and the construction of a government under the rule of law are all important.In view of this,the author intends to study the construction of a third-party evaluation procedure for major administrative decision-making.This article explores from four parts.The first part introduces the reality of third-party assessment of major administrative decisions.Firstly,the related concepts of third-party evaluation of major administrative decision-making are defined,and then the normative documents of the third-party evaluation procedures for major administrative decision-making by the Guizhou Provincial People's Government and the Hefei Municipal People'sGovernment are analyzed.The second part raises the issue of the current third-party evaluation procedures for major administrative decisions.Specifically analyze the specific problems in the evaluation subject,the evaluation object,the evaluation content,the data collection,the analysis and evaluation,the evaluation report,and the application of the evaluation results.The third part analyzes the necessity of the third-party evaluation procedure for major administrative decision-making.It is believed that the construction of the program is conducive to the scientific and democratic requirements of major administrative decision-making,is conducive to the construction of the rule of law government,is conducive to the exercise of civil rights,and is conducive to the unification of procedures.The fourth part introduces the specific design of the third-party evaluation process for major administrative decisions.The evaluation subject is selected by the decision-making organ or the decision-making executive organ from the social organization or professional institution.At the same time,the evaluation participant is set up to form constraints and supervision on the evaluation subject,the decision-making organ and the decision-making executive.The assessment targets were determined based on evaluability criteria and seven assessments were specifically set.A dedicated information team is set up in the assessment body to be responsible for all information collection,review and collation.The evaluation report is produced by the evaluation body and submitted to the decision-making organ or the higher-level administrative organ of the decision-making executive.The evaluation results must be announced to the public and executed by the decision-making organ or decision-making executive.
