On The Construction Of Lifelong Accountability System For The Major Administrative Decision-making

In recent years,there are many problems in the administrative decision-making field,such as the improper exercise of the decision-making power and the "decision making of the head",the root of this phenomenon lies in the lack of the accountability system of major administrative decisions.In order to exercise the right of democratic supervision better and restrict the administrative power of the administrative decision-makers,it was proposed to establish the system of life-long responsibility investigation for major administrative decisions in the fourth Plenary Session of the 18 th CPC Central Committee.Based on this background,this paper launches a research on lifelong accountability system of major administrative decisions.The significance of this study is to participate in the discussion of the construction of the system of life-long responsibility investigation in major administrative decisions,to promote the further development of the administrative accountability system and to provide a solution for the difficulties faced in the practice of responsibility.The first part is to analyze the connotation of the system and the connotation of several basic concepts.It is clear that the construction of the system is necessary,which can standardize the operation of the administrative decision-making power,promote the development of the administrative accountability system and the construction of the responsible government.On the other hand,the construction of the system also has theoretical necessity.Under the guidance of the hypothesis of human nature and the theory of the limited government and the responsible government,it is required to speed up the construction of accountability in the field of administrative decision-making.In the second part,we analyze the legal foundation and soil of the system in our country.First,we analyze the legislative situation at the central level,then analyze the local level about the system,and then understand the whole system of the central and local institutions in our country,and make some achievements in our country.There are still many shortcomings in the legislation of the major administrative decision responsibility,such as the lack of law,the low effect of the local legislation,the lack of attention to the accountability,and so on.This further illustrates that it is more necessary to establish the life-long investigation system of the major administrative decision responsibility in China.The third part is the analysis of the text of the local legislation.After understanding the general situation of the legislation,some local legislative texts are selected to analyze the provisions of the contents,from the principle of imputation,the scope of the matters,the type of responsibility and so on,to compare the local legislative texts and to analyze their problems,and to provide some ideas for the construction of the following system.In the fourth part,propose the legislative proposals and ideas about how to build a life-long accountability system for major administrative decision responsibility should be put forward.It is necessary to speed up the formulation of the administrative accountability law in the Central Committee and optimize the local legislation.The basic principles for the establishment of a unified system are the principle of consistent power and responsibility,statutory accountability and adaptation to fault and responsibility,and further point out the specific construction.Other problems in construction,such as accountability,starting standards,responsibility subjects and procedures,etc.In general,it is necessary and possible to construct this system in our country.This article proposes some specific suggestions and ideas for this purpose,aiming to promote the construction and development of the system.
