Study On The Dilemma And Solutions Of Administrative Law Enforcement Of Maritime Department In G City

The Third Plenary Session of the 18 th CPC Central Committee pointed out that under the requirements of the development of a modern socialist market economy,it is necessary to "transform government functions and deepen reform of the administrative system." In 2013,the Ministry of Transport issued the “Opinions on Strengthening the Construction of Revolution,Regularization,and Modernization of the National Maritime System”.Focusing on the overall goal of the central government to deepen reform,it proposed to boost continuous maritime law enforcement reform,promote management innovation,and improve maritime comprehensive competitiveness in an all-round way.In recent years,the academic circles have carried out a lot of research on how to deepen the reform of the transportation system and innovate the administrative law enforcement mode,which has formed inspiring results.The main point of view is to establish a comprehensive law enforcement team and promote marketization of traffic management functions to adapt to economic development by drawing on the experience of developed countries.These studies have enhanced our understanding of the field of transportation and maritime law enforcement,but at the same time left aspects for improvement.For example,the existing research results are mostly concentrated on the top-level design,having no in-depth study on grassroots maritime law enforcement,and there is also lacking the perspective of public management theory when we proceed from the perspective of transportation disciplines.In the context of comprehensively advancing the rule of law and deepening the reform of administrative law enforcement of water transport,the article adopts the methods of literature analysis,case analysis,comparative analysis,and combines the theory of rule of law government and holistic governance with the theory of new public management to acquaint a comprehensive understanding of the dilemmas encountered by G city maritime navigation system in the grassroots law enforcement process.It has summed up the root causes of above dilemmas aiming at these prominent problems including the conflict between the present situation of traditional social life and the requirements of modern law enforcement,the conflict between the maritime regulatory requirements and the regulatory capability,the conflicts of inequality between jurisdiction and responsibility of Maritime Law Enforcement,the conflicts of interest under the multi-management mode and the coexistence of management blind spots.Reasons are mainly in the following four aspects: First,inconsideration of specific status quo of Inland River in Maritime laws and regulations;Second,Improper design of agency function of maritime administrative law enforcement department;Third,the backward maritime administrative law enforcement information technology and law enforcement concepts;Fourth,the neglected the participation of social organizations and citizens in maritime administrative law enforcement.Finally,on the basis of synthesizing the practice of administrative law enforcement of maritime affairs system in G city,the author put forward following countermeasures and suggestions to get rid of the dilemma of maritime administrative law enforcement in G city.First,speeding up administrative assistance regulations and local legislation;second,strengthening coordination and integration of maritime institutions;third,accelerating the construction of maritime modernization equipment;Fourth,increasing the training of maritime law enforcement teams;Fifth,improving the supervision and evaluation mechanism of maritime law enforcement.Through the above-mentioned research,it is hoped that it will be helpful to the maritime law enforcement in the G city.Comparing with the existing research,the difference of this research is that it not only uses the holistic governance and other public management theories and methods,but combined with the current situation of the grassroots maritime law enforcement in the G city to propose corresponding solutions.Moreover,it provides certain reference value for the problems of maritime administrative law enforcement in other regions as well,especially the common problems faced by inland maritime affairs in the law enforcement process.
