Research On Self-discipline Of Copyright Industry In Network Audiovisual Industry

According to the "2018 China Network Audiovisual Development Research Report"(hereinafter referred to as "Report")released by China Network Audiovisual Program Service Association,as of June 2018,the number of users of various popular short video applications reached 594 million,accounting for the overall size of Internet users.74.1%,and the young pattern is outstanding.2017 and 2018 are the period of the overall outbreak of the short video industry,accompanied by serious copyright infringement issues.The National Copyright Administration reported in the report on the results of the "Jianwang 2018" special action work: The "Jianwang 2018" focuses on key areas such as network reprinting,short video,animation,knowledge sharing,audio books,etc.There were 1.85 million infringement and piracy links,1,330,000 infringing and pirated products were seized,and 544 cases of network infringement and piracy were investigated,including 74 criminal cases and 150 million yuan involved.It can be seen from these data that the copyright infringement problem of the network audiovisual industry is more serious and has become the focus of the government and the public.At the moment when the intellectual property legal system is globalized and the network legal system is still immature,government administration has become one of the most important methods for the governance of online copyright infringement.In fact,the self-discipline of the copyright industry is also a powerful complement to the rule of law system.It can not only become an important copyright operation and management mechanism,but also should be the subject of academic research.In essence,industry self-discipline is a form of self-governance.The realization of selfdiscipline in the copyright industry requires a certain independent organization.These independent organizations are copyright industry associations.If we can rely on the power of industry associations to promote industry self-discipline through the management of the industry itself,assist the government in market regulation.However,due to the lack of domestic research on the self-discipline of the copyright industry,there is no systematic understanding and analysis of the self-discipline of the copyright industry,which also forces China's industry self-discipline to remain stagnant.This article is divided into six parts.The first part is the introduction part,which mainly introduces the research background,research significance,research methods and research innovation points,and summarizes the existing domestic literature on the self-discipline of copyright industry.The second part mainly focuses on summarizing the main body of self-discipline in the copyright industry,and through the combing of self-discipline subjects,this paper divides the self-discipline subjects into four types: service-oriented self-discipline subject and platform-type self-discipline subject.The self-disciplined subject of management and the self-discipline of collective autonomy.The third part is based on the three indicators of composition,management content and operation mode.It is found that the existing copyright organizations can be divided into one-dimensional self-discipline system based on producer self-regulation;The dual self-discipline system and the multi-disciplinary system of multi-party negotiation.This classification method and classification result are also one of the innovations of this paper.The main body of this paper is organized around these three types of selfregulatory organizations.The last part is the research conclusion of this paper.According to the three indicators of composition structure,management content and operation mode,it is possible to divide the existing network copyright organization into a one-dimensional system,a binary system and a multi-dimensional system.In the comparative analysis of the three,the multi-disciplinary system is a balanced system between government regulation and industry self-discipline.It is more flexible,independent,adaptable and higher in dealing with copyright market and policy failure.Efficiency is more suitable for the governance of infringement issues in the network audiovisual industry.According to the current research literature on copyright self-discipline of the domestic network audio-visual industry,it is basically researched from the perspective of law,and the research objects are also focused on the revision of copyright law.There is little research on the entire network copyright self-discipline system.This paper studies from the perspective of news and communication,and combines the selfdiscipline system of the foreign network audiovisual copyright industry to try to make the existing copyright self-discipline system have a more distinct classification.The research results of this paper can indicate the development of the self-discipline system of the domestic network audio-visual copyright industry,and can provide a clear direction for the construction of the domestic copyright industry self-discipline system.In general,there are few studies related to this in China.The classification of copyright self-discipline system is unique.This will open up ideas for the construction of copyright self-discipline system in China's network audio-visual industry and explore the road of reform.
