On Cooperation On The International Rule Of Law In Global Climate Governance

Controlling global climate change,keeping safe living environment and sustainable development capability for the current and future human society is one of the important contents of global governance.Since the implementation of the United Nations framework convention on climate change(UNFCCC),international cooperation to control climate change has been advancing.On the one hand,the development of international climate change law has made an important contribution to the control of global climate change,making global climate governance a step closer to the international legal system.On the other hand,the international political game also plays an important role,when the international climate change law shows the characteristic of "soft law",the game between big countries which have the advantage of international voice then leads the direction of global climate governance.Therefore,it is an important part of international cooperation in global climate governance to seek international cooperation on the rule of law in global climate governance and better play the role of international law in controlling and regulating climate change.This paper focuses on the central topic —— international cooperation on the rule of law in global climate governance,from the following aspects.Firstly,it introduces the global climate change governance in global governance as a whole,including the generation,principles and value objectives of global climate governance,as well as the legal basis and historical process of international cooperation on global climate issues.Then,the paper analyzes the difficulties in international cooperation on the rule of law in global climate governance,including the complicated allocation of rights and obligations of countries,difficulties in the implementation of international law,and difficulties in the supervision and settlement of climate issues.Further,this paper proposes the optimal path of international legal cooperation in global climate governance,including optimizing the allocation of national rights and obligations,giving play to the role of other members of the international community,promoting the effective implementation of international climatetreaties,and improving the dispute settlement mechanism of global climate governance.Finally,through the analysis of international rule of law cooperation in global climate governance,the position and action of China’s participation in global climate governance are concluded.Global governance of climate change requires an international rule of law with climate change law as its core,major countries as its leading role and diverse actors as its participants.Only by implementing good laws and good governance against global climate change can we better safeguard and coordinate the interests of all countries,protect people’s basic rights,save the living environment of mankind,seek greater global well-being and continue human civilization.
