Study On The Legal Regulation Of Green Takeaway Packaging In China

China's takeaway industry has gone through the past few years of the war of subsidies and mergers and acquisitions,and now it has entered a barbaric leap-forward growth stage.However,there are no relevant laws and regulations on takeout packaging waste,which has led to the growing scale of the takeout industry,resulting in the increasingly serious pollution problem of takeout packaging garbage.The large increase of takeout packaging garbage has also affected China's urban waste.The composition and structure of refuse make the problem of urban refuse pollution more and more serious in China.Long-term treatment of takeaway packaging as municipal solid waste will result in waste of resources,which is contrary to the basic concept of green development in China.In order to properly solve this problem,we urgently need to formulate relevant standards,laws and regulations for the disposal of takeaway packaging waste.There is no specific legislation for packaging in China,especially the takeout industry as a new emerging industry,the treatment of packaging waste is even less regulated by legal norms.In order to make the green development of takeout industry in China legal basis,relevant departments should speed up the pace of legislation and formulate effective legal norms.The author summarizes the current standards and policies related to foreign and takeaway packaging in China,and makes a thorough comparison and analysis between them.The successful experiences of EU,Japan and Germany in the treatment of packaging waste are mainly used for reference.It is found that the lack of relevant laws and regulations in our country is that there is no clear subject responsible for pollution,and the responsibility division of the relevant subject is not clear,which basically leads to the embarrassing situation that the handling of takeout packaging waste in our country is in a position where the subject of responsibility can not be restrained and the subject of law enforcement can not be governed.In order to solve this problem,this paper tries to discuss and analyze the basic principles,the responsible subjects,the main responsibilities and the unified standards of takeaway packaging,in order to explore a legislative way to improve the green development system of takeaway packaging in China.
