Research On Risk Assessment System Of Major Administrative Decision

Under the background of promoting administration according to law and building a government ruled by law,the major administrative decision has attracted the attention of the academic circles because of its wide scope and wide influence.The local authorities have also carried out a series of institutionalized designs for major administrative decisions,and successively formulated provisions on the procedure for major local administrative decisions.The "decision of the CPC Central Committee on comprehensively promoting administering the country according to Law" also mentioned the need to improve the decision-making mechanism.This shows the importance the central authorities attach to major administrative decisions.However,as the concept of administrative management,it is difficult to define the important administrative decision from the perspective of administrative law.With the development of the new administrative law,the voice of making the administrative procedure law is more and more high.In order to promote the development of the new administrative law,it is difficult to avoid the study of the important administrative decision.Our society is in the transition period,and the risk is ubiquitous.As the legal procedure of the important administrative decision,risk assessment is especially important in reducing the risk of decision,coordinating the series of decisions,preventing and controlling the risk.However,the risk assessment system for major administrative decisions presents problems such as the non-neutrality of the evaluation body,insufficient public participation,excessive emphasis on stable assessment,lack of uniform criteria for the process of incorporating the decision into the risk assessment,and imperfection of the accountability mechanism,and so on.The risk assessment system for major administrative decisions needs to be improved.Under the background of the new administrative law,the author thinks that the risk assessment system should be constructed from the perspective of cooperative administrative law,bring into play the respective advantages of the government and the public,cooperate and negotiate,and promote the perfection of the risk assessment system in communication and communication.To realize the scientific and democratization of major administrative decision making,so as to achieve the goal of perfecting the decision-making mechanism.This paper is divided into four parts.The first part is to define the relevant concepts of major administrative decisions and to analyze their functions.In the second part,through the analysis of the theory of cooperative administration,administrative procedure control mechanism,balance theory and risk administration theory,the author establishes the theoretical foundation for the risk assessment system of major administrative decision.The author thinks that the core is cooperative administration.At the same time,it also introduces the function of risk assessment system.The third part mainly introduces the content of risk assessment,combs and inspects the relevant legislative provisions of the central and local governments,and analyzes the problems and causes in the theory and practice of the risk assessment system of major administrative decisions in China.The fourth part is to systematize and perfect the risk assessment system of major administrative decision.
