Study On Legislative Flexibility In National Autonomous Areas

Reasonable and effective use of national autonomous areas legislation and flexible adaptations with the specific conditions of the local law,is of socialism with Chinese characteristics is the important embodiment of the construction of legal system,its for the perfection of legal system construction and development of the national autonomous areas in China with helpful with the advancement of the rule of law in our country and development of the regional national autonomy law alternative practice,however,presents some problems,these problems to some extent,restricted the local rule of law and the development of social economy The purpose of this study is to put forward reasonable measures to solve the problems existing in the practice of flexible laws of ethnic autonomous areas,so as to improve the legislative quality of ethnic autonomous areas in China,and promote the construction of rule of law and economic and social development of ethnic autonomous areas.This paper consists of four parts: the preface and the epilogue:Part one: the author based on the research of the legal alternative and related concept,formed its own ideas about legal alternative,based on the analysis of the legal significance of flexibility,clarify the law the principle of flexibility,and through the principle and form to analyze the effectiveness of the legal alternative level,national autonomous areas is the research of legal alternative national autonomous areas to provide the necessary theoretical basis.Part two: using the method of document retrieval and comparative analysis,the author summarizes the practice of law adaptation in national autonomous areas,and summarizes the effect of law adaptation in national autonomous areas from the practice of law adaptation in national autonomous areas.Part three: the second part through the analysis of the status,explore the problems existing in the legal alternative national autonomous areas may,for example:there aren't many legal alternative quality is not high contents of the regional imbalance full implementation does not reach the designated position clarify the causes of problems,such as: not enough understanding of the importance of legal alternative,legislators' professional quality is not high,the rule of law in national regions have different development level,law is lack of effective supervision system flexibility.Part four: this part is the focus of this paper.Through the analysis of the problems and causes in part iii,how to solve the existing problems and specific measures of the law adaptation in ethnic autonomous areas.
