Study On The Legal Status Of Intelligent Machine From The Perspective Of Artificial Intelligent Evolution

The rapid development of artificial intelligence is a great liberation of human wisdom,and it also has a great impact or even subversion to human social order and ethics.When humankind are pursuing the infinity of the development of artificial intelligence,they also have to face up the conflict between innovation and the security vulnerable caused by this technology.As far as the challenge to the artificial intelligence's legal system is concerned,whether to grant the status of legal subject is the core problem that legal researchers need to solve.This paper objectively introduces the technological evolution of and clearly points out that the essence of artificial intelligence is machine rather than human.The paper have sorted out the views of legal scholars at home and abroad on this issue,and believes that in the case that artificial intelligence is difficult to break through and should not surmount the technical ceiling and move toward the stage of strong artificial intelligence.In order to solve the risks and threats brought to humans in the process of artificial intelligence development,this paper argues that the legal personhood of Intelligent Machine should not be given,proving by the reflection of the artificial intelligence ethics,the basic theory of law and the existing institutional conceptions.Finally,in the summary and future prospects,this paper proposes two practical suggestions for science of law to study in the future.
