Research On The Subject And The Object Of Post-Legislation Evaluation Of Local Archives

In March 2011,after the fourth session of the 11 th National People's Congress declared that the socialism legal system with Chinese characteristics had been formed,China entered a new era of transformation from focusing on "quantity" legislation to "quality" legislation.By carrying out post-legislation evaluation,it is an effective measure to ensure the quality of laws through regulations supervision and inspection of the legislative quality,implementation process and implementation effect of laws and regulations.The significant role of the regional archival legislations and local regulations is to implement the higher-level law and promote and ensure the development of regional archival cause.So,the relevant authorities should also make timely and sound post-legislation evaluation,laying a solid foundation for the improvement of the quality of regional archival legislations,for the promotion of the archival administrative law enforcement and the construction of local archival legislation system.When post-legislation evaluation of local archives is conducted,the first thing that needs to be clarified is the question of“who will carry it out” and “what will be carried out”,that is,the subject and object of post-legislative evaluation.This paper takes "the subject and object of post-legislation evaluation of local archives" as the research object,and employs the more advanced post-legislation evaluation theory to examine and discuss the current work effect of evaluation subjects and participants after the local archives legislation.Besides,the paper evaluates the applicable status of the different type's object,with the aim to cause local legislatures and local administrative agencies to attach importance to the post-legislation evaluation of archives as well as to provide reference for selecting appropriate evaluation subjects and participants and determining different types of objects for legislative evaluation.The content of the article is as follows.Chapter one,the introduction,mainly deals with the basic information of this research,including the background and significance of this research,the status quo from home and abroad,the basic concepts,the research structure,the research methods,the research ideas as well asthe innovations.Chapter two and chapter three focus on the research into the subject and the object of post-legislation evaluation separately,put forward related concepts,review the current evaluation situation,analyze the present problems arising in work and research and bring up solutions to these problems.Chapter four is the conclusion and outlook,suggesting that evaluation subject should be enriched after the legislation,evaluation object should be improved after the legislation of regional archival,the academic circles should follow up in time and conduct assessment research after the regional archival legislations,and the regional archival administration should promote and advance the assessment after the regional archival post-legislations.In the future,when carrying out the assessment on post-legislative evaluation of archives,the relevant authorities and administrative agencies should pay close attention to both the academic research process and achievements of the post-legislature evaluation of archives and the industry's feedback on the application of laws and regulations.The academic community is supposed to carry out the overall research on the post-legislative evaluation of archives,therefore forming a complete research system.For this purpose,scholars should strive to achieve the integration of archival and legal theories,and in turn improve the theoretical accomplishment and the quality of academic research achievements.
