Study On Agreement The Of The Tripartite Free Trade Area Between East And South Africa

With the development of countries and regions in the world,they are increasingly connected with each other.Economic globalization and regional integration are the main trends of world economic development.The in-depth development of economic globalization has gradually formed a unified market in the world,and Africa has also followed this trend and accelerated the process of intra-regional cooperation.This paper takes the tripartite free trade agreement on Africa launched in 2015 as the research object,analyzes the content of the free trade agreement,and combines the "One Belt And One Road" initiative to discuss the cooperation between China and the tripartite free trade agreement on southeast Africa.This paper is divided into five parts.The first part mainly introduces the historical background — COMESA,EAC,SADC,through many years development,the internal barriers are still difficult to eliminate such as depending on each other,trusting imbalances between member states.The second part gives a brief overview of the legal system:organizational structure,basic principles of the agreement and its related annexes,and analyzes the characteristics of the agreement.The third part further analyzes the legal document from the aspects of trade in goods,trade in services,intellectual property and dispute settlement mechanism.In terms of trade in goods,tariff liberalization,rules of origin,health and phytosanitary inspection,trade remedy measures and other contents are analyzed.In terms of trade in services,competition policy,consumer protection and business flow are analyzed.Finally,the protection of intellectual property and dispute settlement mechanism are analyzed.The fourth part demonstrates the challenges that affect the implementation of the agreement from the perspectives of the cooperation mechanism and the current development situation:the division organizations is unclear,the liberalization of trade in goods needs to be improved,the level of trade in services is low,and the dispute settlement methods are lack of characteristics.It makes the implementation of FTA lack of a strong legal mechanism.A short-term economic chasm and overlapping memberships further hamper the road of alliance.The fifth part mainly puts forward suggestions on the free trade cooperation between China and the three parties.Although the implementation of the FTA faces many challenges,under the "One Belt And One Road" initiative and the Forum on China-Africa Cooperation,thecooperation between China and the free trade area is also timely.Therefore,the author suggests that China and FTA should adopt the strategy of promoting negotiations step by step,avoid high level and wide range,give play to the complementary advantages of China and Africa,and jointly promote the long-term development of China-Africa economy...
