The newly revised food safety law makes relevant provisions on the legal liability of the third party platform of online food trading(including the third party platform of online food ordering),but the connotation of the liability of the third party platform is still unclear.The vague regulation of platform supervision responsibility leads to the excessive expansion of platform responsibility in reality,as well as the buck-passing of the platform,which forms the blank of supervision.Through empirical and comparative analysis methods,The legal status of the third party platform is analyzed,In this way,the supervision and responsibility basis of the third party platform for online meal ordering is clarified,In view of the practical problems faced by the third-party platform supervision,this paper proposes countermeasures to improve the platform supervision responsibility.The intermediary contract legal relationship between the third party platform of online meal ordering and the customers and the supervision responsibility of the platform given by the administrative law constitute the power source of the supervision right of the third party platform.When performing regulatory responsibilities,third-party platforms are confronted with such problems as lax qualification examination,formalized network access security training,lack of process supervision,ineffective supervision of distribution links and improper treatment of evaluation classification,It is necessary for platforms to innovate regulatory means,standardize online market transaction access,establish and improve the platform's hierarchical and classified management ability,improve the platform evaluation system,and share information with the government,etc.,and coordinate with the society for collaborative supervision.
