Nowadays,our Financial Holdings Company(FHC)has grown rapidly,but there are still some problems.Using the holding of Financial Institutions permits both Mixing Management and Risks Assembling of kinds of financial Institutions.Although our present concept of supervision transfers to Behavioral Supervision and Functional Supervision,the traditional legal Institution still leans forward to a standard pattern under the Separated Supervision System.This paper studies the development and present situation at home and abroad within a range of concept about FHC and Firewall System.It also summarizes the regulation about Firewall System and normative system from the authoritative documents.The paper finds out the risks of FHC from the traditional bank,insurance institutions and securities companies.Then comparing with the present legal institutions,the shortage of such institutions will rise to the surface.Finally,it can be given more appropriate suggestions.According to raise problems,analyze problems and solve problems,this paper consists of three parts except the preface and conclusion.The preface puts forward what Firewall System and FHC need to improve from present financial supervision.The first part is the definition about related notions.First one is the definition of FHC.The writer writes up the national legislation,domestic academic research and related policy document to reach the definition of FHC.Next one is to ensure the range of study.The writer analyzes the theoretical basis and specific content of Firewall System.The second part relates to the development history of Firewall System and its total system.The writer finds out the special risks about FHC from single bank institution,insurance institution and securities institution.Then it is used with present legal institutions for contrast to find the shortage.The third part puts forward countermeasures for consummating system.The writer analyzes the shortage of present system,learn oversea experience and some related theoretical research.
