Research On The Legal Safeguard Mechanism Of Social Assistance For The Parents Who Have Lost Their Only Child

Parents who have lost their only child is a special group born under the special birth policy of our country.Since the 1980 s,China has implemented the one-child policy in order to reduce the social dependency ratio and increase the speed of economic development,ushering in a period of demographic dividend of nearly three decades at the expense of some citizens' reproductive rights.But the one-child family structure presents the "inverted pyramid" in high-risk state,under the background of the existing social security in our country,once the one-child accident disability,death,aging onechild parents will lose their main source of pension economy,into a pension economic chain rupture,psychological trauma,lack of social support,such as multiple difficulties,become the urgent need of social assistance of the old man.Although China has fully opened up the policy of second child at present,due to material pressure or pursuit of quality of life and other factors,there are still quite a number of young people of childbearing age who choose to have only one child,after the abolition of the one-child policy,the "one-child family" emerged on the basis of self-selection also faces the risk of losing its independence,"Parents who have lost their only child" is not just a temporary and accidental group,and the proportion of China's population structure will become larger and larger in the future.More and more elderly people are facing material,spiritual and provide for the aged difficulties.However,at the same time,the social relief work for the lost onlychild old man in China is confronted with such problems as lack of specialized legislation,loose related laws and regulations,low operability,uneven level of local practice,and imperfect legal guarantee mechanism of the relief system,the process of social assistance for the parents who have lost their only child has developed slowly.Based on this,this paper attempts to use bibliometric analysis,case analysis,comparative analysis and other methods to support the basic human rights theory,social cooperation theory,special sacrifice theory and other legal theories.This paper analyzes the relevant legislation and practice at home and abroad,and finally puts forward Suggestions for the improvement of the legal safeguard mechanism of social assistance for the parents who have lost their only child.
