The family planning policy was implemented in the late 1970 s to help China's economy,politics,society,culture,ecology civilization and other comprehensive aspects have rapid development.Now four decades of the one-child policy quietly out of the stage of history.However,as a results of the policy,one-child died families are growing.Our country only offers material subsidy rather than spiritual consolation.The government should take the responsibility to give spiritual consolation to those families.The legal gap of spiritual consolation made these families lack legal ways to protect their own rights and interests.In our country,the existing social security system of one-child died families is not yet comprehensive.If our country bring spiritual consolation into the social security system and develop corresponding reasonable institution,it can effectively help the parents to get out of the mental difficulties and fill the legal gaps in the social security system.However,it is different from other types of social assistance,from aspects of the subjects,contents,methods and so on.Because of the professional nature of the content,the government should pay special attention to it and make basic disciplines and focuses clear.Also,spiritual consolation of one-child died parents need country's financial support.National Health and Family Planning Commission of the People's Republic of China(hereinafter referred to as the "NHFPC")is the well-deserved management subject of the relief work.In this relief work,NHFPC should develop a comprehensive legal norms and institutions to achieve optimal allocation of resources and supervision.It also needs the active cooperation of other government departments and the nation-wide social participation.The responsibility of the main departments should bear the corresponding consequences result from their negative management.In order to alleviate the social assistance problem,we should discuss the different ways of spiritual consolation of one-child died parents.From Institutional pension and Communities Construction on Old-age,and let the parents have the right to choose different ways,different regional pension mode,enjoy more personalized spiritual rescue experience.Under the supervision and management of NHFPC,the different subjects carry out their duties,build a mature local spirit to soothe the social aids legal system,and help the unhappy parents to establish a better spiritual home.
