Study On The Operation Of Investigation Power Of County Supervisory Organs Under Synergetic Governance

Since the 18th National Congress,the Party and the state have promoted the anti-corruption work with firm anti-corruption determination and strong anti-corruption measures.In November 2016,the General Office of the Central Committee decided on the"Pilot Plan for the Reform of the National Supervision System in Beijing,Shanxi and Zhejiang Province",and then the Standing Committee of the National People's Congress adopted the"Decision of the Standing Committee of the National People's Congress on the Pilot Work of the Reform of the National Supervision System in Beijing,Shanxi and Zhejiang Province".This marks the beginning of the reform of the supervision system in China.At the beginning of 2018,the reform of the supervision system was carried out throughout the coumtry.Supervisory organs at the central,provincial,municipal and county levels were set up from top to bottom,and work together with Discipline Inspection Departments at the same level.Anti-corruption supervision has entered a new stage,the stage of legalization of anti-corruption,so as to promote the improvement of the national corruption governance level and capacity.However,as the grass-roots supervisory department in the national supervisory system,the county supervisory organs are also the most critical component.They have achieved results in the early stage of their establishment,but also face many obstacles,especially in the practice of the investigation power.The main problems are insufficient conditions for the operation of investigative power,the need to establish internal and external cohesion and coordination mechanism in the exercise of investigative power,the establishment of internal and external supervision and coordination mechanism in the practice of investigative power,and the standardization and unification of laws and regulations.Therefore,from the theoretical perspective of synergetic governance,the author discusses and analyses the necessity and feasibility of the unified investigation mechanism,the cohesion and coordination mechanism in case transfer,and the establishment and improvement of supervision mechanism in the exercise of supervision authority in S county,so as to provide countermeasures and suggestions for the further development of supervision institution reform at the grass-roots level.Based on the interview method,supplemented by the statistical analysis of questionnaires,under the theory of synergetic governance,and guided by finding and solving problems,this paper makes an analysis of the characteristics,influencing factors,obstacles and causes of the operation of investigation power of S County supervisory organs,so as to provide theoretical suggestions for S County supervisory organs to exercise investigation power more effectively.The writing framework of this article is as follows:The first part is an introduction.This part mainly introduces the research background,research significance,domestic and foreign literature review.Finally,the research methods and innovations of this paper are introduced.The second part includes the definition of the relevant core concepts and the theoretical basis.This part defines the concept of the supervisory authority and its investigative power,and briefly discusses the theoretical perspective-synergetic governance theory.At the same time,it analyzes the compatibility between the theory of synergetic governance and the operation of the investigation power of the supervisory committee.Finally,it introduces the relevant policies and legal provisions of the state's relevant supervision system reform,and the spirit of the speech of the main leaders of the country on the supervision system.The third part is the analysis of the status quo of the investigation power of the S county supervisory authority in Hubei Province.Based on the statistical analysis of the county's questionnaire and the analysis of the interview data of relevant staff,this part analyzes the effectiveness and obstacles in the early stage of the establishment of the supervisory authority,and specifically analyzes the problems in operation of investigation power.The fourth part discusses the measures and suggestions for the effective use of investigation rights.Starting from the exercising subject and the participating subject of the investigative power,and using the theory of synergetic governance,this paper explores how to establish an efficient and scientific mechanism for practice the investigative power from inside to outside,and how to establish an internal and external supervisory mechanism in the supervisory organ in S county.The innovation of this paper lies in:First,the innovation of research content.Under the background of the reform of the national supervisory system,this paper studies the investigative power of the newly established National Supervisory Committee,and closely follows the practice of the reform of the national supervisory system.It can show the achievements and confusion of the reform of the national supervisory system for the first time.Secondly,there are some innovations in theoretical perspectives and research methods.The existing theoretical perspectives on the national supervision system mainly focus on corruption theory and the legalization theory of the supervision system.Based on the theory of synergetic governance,this paper combines the questionnaire survey method with the interview method to analyze the status quo of the investigative power of the supervisory committee,summarizes the effective experience,analyses the confusion,and its causes and characteristics,and puts forward specific countermeasures and suggestions.Thirdly,specific measures and suggestions are put forward.Based on the theory of synergetic governance,this paper starts from two aspects:the exercising subject and the participating subject of the investigation power.In view of the obstacles faced by the supervisory organs of S County in Hubei Province in the process of operation the investigation power,this paper emphasizes the coordination of multi-subject,the improvement of specific institutional guarantee,constructs the supervisory information platform,implements the leading responsibility system in each investigative case,and promotes the establishment of the supervisory mechanism.And further improve the relevant laws and regulations,effectively enhance the efficiency of the investigation power operation mechanism,and build an efficient,unified and coordinated supervision mechanism of the investigation power operation mechanism and achieve a combination of internal and external supervision mechanism.
