In order to deepen the reform of the judicial system,improve the efficiency and quality of case handling,and realize the unification of the responsibility,power and interests of the post system prosecutors,the supreme people's procuratorate proposed to establish and implement a scientific,reasonable and normalized performance evaluation mechanism for the post system prosecutors.A scientific performance evaluation system is the basic way and important means to ensure the procuratorial organs to perform their duties according to law.A comprehensive,objective and fair evaluation of the procurators within the posts is conducive to mobilizing the enthusiasm and initiative of the work of the procurators,and continuously improving the ability of law enforcement and the quality of case handling.However,at present,the performance appraisal of the procuratorial system still refers to the performance appraisal system of the government administrative system,and the appraisal orientation and indicators are vague,lacking the legal attributes of the procuratorial organ and insufficient to evaluate the procurators in a scientific and fair way.This paper combines the performance appraisal theory of management with the practice of performance appraisal of procuratorial organs,points out the existing problems and deficiencies based on the provisions of the current performance appraisal system and the current situation of practice,and explores the establishment of a more scientific and reasonable performance appraisal system.The first part is the definition of post prosecutor performance evaluation.Through the theoretical analysis of the performance evaluation,the author scientifically defines the meaning,characteristics and functions of the performance evaluation of the post system prosecutor and the functions of value orientation,management supervision and incentive reflected in the procuratorial work.The second part is the investigation of the performance evaluation system of foreign prosecutors.Analyze the typical countries such as America,Britain and Germany,procuratorial organs performance evaluation system characteristic and the practical experience,summed up,which can be used for reference first,consummates the external evaluation system and objection relief program,2 it is to set up a universal index and individualized evaluation appraisal project,three is to establish the process control and application of the results of dynamic assessment mechanism,four is fully based on procuratorial functions conform to the procuratorial business attribute.The third part,our country post procurator performance appraisal system present situation and the existence question.Based on the development,legislation and practice of the performance evaluation system of China's procuratorial organs,this paper puts forward the problems existing in the performance evaluation of China's procuratorial organs.This paper puts forward some problems from the aspects of unreasonable performance evaluation indexes,unreasonable evaluation methods and contents,failure of evaluation to reflect the attributes of legal and procuratorial profession,insufficient formalization of evaluation procedure and application of results,and relatively single assessment subject influencing the authority of evaluation.The fourth part,the suggestion to improve the performance evaluation system of the public prosecutor in the post.Respectively from science and its performance evaluation index of the prosecutor,the reasonable configuration of prosecutors performance evaluation methods and content,set up a performance evaluation system should reflect the judicial and procuratorial organs attribute of business characteristics,to set up the evaluation process and results of using dynamic activity mechanism and the appraisal main body improving Suggestions for examination and assessment of the bidirectional interaction mode,etc.
