Improving Social Assistance Legal System Under The Background Of Targeted Poverty Alleviation

With the progress of targeted poverty alleviation strategy,social assistance legal system plays a more important role in the resistance of poverty risks by poor people.As the administrative supply,social assistance is the particularly important reflection of administrative assistance,is conducted within the scope of administrative laws,and is constrained by China's laws and regulations.Guaranteeing poor people's access to assistance and standardizing the behaviors of the assistance entities are the key contents of administrative legal relations for social assistance.Based on the observation of poor rural household samples in Guangxi Province,this thesis analyzes the realistic dilemma of the current social assistance system under the background of targeted poverty alleviation,adopts the theories in administrative laws to analyze the fundamental rule of law observed by social assistance,and improves social assistance legal system by combining the targeted advantages of "targeted poverty reduction" and the objectives of "targeted poverty alleviation".In this way,conducting poverty governance in accordance with legal principles,regulations and procedures.Part One introduces the topic selection background and research significance,and offers an overview of the new objectives raised for the development of social assistance legal system in China under the background of targeted poverty alleviation.Social assistance legal system undertakes the new tasks of securing the livelihood for the poorest.Under the requirement of"guaranteeing the quality of poverty alleviation and preventing excessive welfare",how social assistance legal system clarifies its own position and improves and supplements the system itself has some practical significance;Part One also analyzes relevant concepts.Part Two analyzes three samples on poor villages and family poverty status of Guangxi,and objectively analyzes the status of poverty,poverty alleviation implementation means,and assistance means,providing empirical support to problems reflected below.Based on the sample analysis for some poor population in Part Two,Part Three summarizes existing problems for the current social assistance system and its defects in legislation,system design,and system implementation.Part Four explores the fundamental rule of law that should be observed by social assistance legal system.First of all,under the theory of limited government,the thesis summarizes the bottom line for limited responsibilities of government to guarantee basic survival and development.The upper limit of limited responsibilities for the government is the responsibility of providing system guarantee.Secondly,social assistance should stick to the principle of proportionality of administrative laws,namely to realize the necessity required for public interest and the appropriateness to realize social equality and proper assistance.Finally,social assistance should also observe the principle of complementariness for social participation.This part provides the theoretical support for enhancing the necessity and rationality of the social assistance legal system.Part Five is about the conception on improving social assistance legal system.Social assistance under the background of targeted poverty alleviation aims to achieve stability,precision,long-term effectiveness and standardization of assistance.Specifically,we should promote social assistance legislation to consolidate the achievements of targeted poverty alleviation and achieve stability for social assistance legal system;we should improve the social assistance legal system from assistance objects,content,and means to make social assistance legal system more targeted;we should develop the sustainability of social assistance from industry development,transfer employment and the cultivation of diversified assistance subjects to achieve long-term effectiveness of social assistance legal system;we should strengthen the supervision system for social assistance and perfect legal responsibilities to standardize social assistance legal system.
