Research On Legislation Of Ecological Public Welfare Forest In China

The common challenges facing the world today are the gradual depletion of resources,the severe pollution of the environment and the degradation of ecosystems.In the context of the gradual deterioration of the global climate,general secretary Xi Jinping proposed to strengthen the overall design and organizational leadership of ecological civilization construction.Forests play an irreplaceable role in water supply,biodiversity conservation,and climate change protection.From the classification of forest USES,we can see that the ecological public welfare forest has made outstanding contributions to the improvement of ecological environment,and it is imperative to promote the legislation of ecological public welfare forest protection in China.This paper is divided into six parts:The first part discusses the background,practical significance and the ultimate goal of the legal exploration of ecological public welfare forest,and all the discussions establish the theme of how to protect the ecological public welfare forest.The research and development of this problem at home and abroad,as well as the development trend of ecological forest protection in the legal level are briefly introduced.The research ideas and methods in this paper are briefly introduced.The second part mainly introduce the concept of ecological public welfare forest,the main effect,specific categories,such as the concept of ecological public welfare forest commentaries on the shallow analysis,from the most basic knowledge of ecological public welfare forest,due to the properties of special ecological public welfare forest,decided the protection for its many obstacles exist,explain our country to speed up the ecological public welfare forest protection legislation is imminent.The third part is the existing in our country about legal protection of ecological public welfare forest related laws and regulations for the sorting,induction and summary,find out the existing in our country and the deficiency of ecological public welfare forest protection legislation,and to sum up,for the feasibility,the necessity of ecological public welfare forest protection legislation in China are pointed out.The fourth part is that the function of ecological public welfare forest determines its position in the whole ecological environment,and China has attached great importance to ecological environment in recent years.Therefore,it is imperative to protect ecological public welfare forest through laws.The necessity and feasibility analysis of China's ecological public welfare forest protection legislation is made theoretically.The fifth part introduces some foreign countries with complete legal systems,such as Japan,Finland and Germany.This paper summarizes the advanced experience of these countries in the legal and institutional aspects of the protection of ecological public welfare forests and the good results they have achieved.In combination with China's specific national conditions,this paper draws on the successful experience of major foreign countries and puts forward the legal system and management regulations in line with the development of China's ecological public welfare forests.The sixth part puts forward three frame conceptions for the legislation protection of ecological public welfare forest in China.Based on the successful experience of foreign countries and relevant domestic theoretical research,this paper puts forward the legislative principles that should be followed for the development of China's ecological public welfare forest,the basic system of China's ecological public welfare forest legislation,and the establishment of China's legal liability for ecological public welfare forest.The ultimate goal is to realize the long-term development and sustainable construction of China's ecological public welfare forest.
