The Facilitation Rules Of China’s Commodity Inspection Law And Its Integration With The Trade Facilitation Agreement

Commodity inspection is of vital importance for safeguarding the quality of goods,safeguarding people’s lives and health,even safeguarding national interests.Since the reform and opening-up,with the development of economy and society and the continuous expansion of international trade,China’s commodity inspection has also undergone huge changes,commodity inspection system is also constantly developing,and many policies are also compatible with the requirements of the Trade Facilitation Agreement.In trade environment today,traditional trade barriers such as tariffs have gradually faded out of people’s horizons,but at the same time,some of the more subtle market access barriers have become more popular,causing more and more attention.Complex customs clearance procedures and repeated document requirements have brought many negative impacts on international trade.The Trade Facilitation Agreement hopes to improve the efficiency of the circulation of goods and simplify the international trade by simplifying and harmonizing relevant procedures.Therefore,the integration with the Trade Facilitation Agreement mainly involves its connection with foreign trade,customs,free trade zones and commodity inspection laws,regulations and policies.There have already been many articles on the first three topics that have been analyzed and elaborated accordingly.Therefore,this paper mainly focuses on the integration of the facilitation rules and agreements of China’s commodity inspection law.This paper sorts out the related concepts of commodity inspection facilitation and the rules of commodity inspection facilitation in major trading countries by means of literature analysis,systematic analysis and empirical analysis.The full text is divided into five parts.The introduction part introduces the background,significance,researching status and research methods in China and abroad.The first part is mainly an overview of commodity inspection facilitation,including the concept and history of commodity inspection;the relationship between commodity inspection and trade facilitation and the specific connotation of commodity inspection facilitation.The second part introduces the commodity inspection legal system and trade facilitation rules of the United States,the European Union and Japan,including the internal and external unified institutions,the automatic detention system,the accreditation system of laboratories of the United States,etc.;Regulatory inspection system,"entry verification" system,specialization and official control system evaluation of the European Union;private inspection government supervision,mandatory and voluntary certification system,pre-trial customization,monitoring and order inspection of Japan.The third part is mainly about the rules and requirements of commodity inspection facilitation from the perspective of the Trade Facilitation Agreement,including the transparency,simplification,predictability and legitimacy rules in the general rules;the maximum security,balance of convenience and supervision,independence and professionalism,government guidance market-driven rules in special rules.The fourth part writes about the current Chinese commodity inspection legal system and specific regulations and is divided into two parts:the Chinese commodity inspection legal system and the specific provisions of the current Chinese commodity inspection laws.The current Chinese commodity inspection laws are mainly classified and elaborated as:China’s commodity inspection legal system、the facilitation rules of the "Import and Export Commodity Inspection Law of the People’s Republic of China",the "Implementation Regulations of the People’s Republic of China on Import and Export Commodity Inspection Law"、the "Food Safety Law of the People’s Republic of China"、and the facilitation rules in other commodity inspection regulations.It presents the trade facilitation ideas combined with the background and revision history of specific legal provisions which embodied in the formulation and revision of China’s commodity inspection law.The fifth part of this paper mainly writes about the problems and improvement measures of China’s commodity inspection rules from the perspective of the Trade Facilitation Agreement.It is analyzed from three aspects:the legal aspect,the supporting systems and the institutional functions.In the end,the paper concludes that China’s commodity inspection rules should improve the legal system;adjust the legal inspection catalogue;reform the law enforcement;strengthen the research and application of the risk management system;attach importance to information release and social participation;Enhance the promotion and international mutual recognition of the "certified operators" system of commodity inspection;increase the decentralization of administration;strengthen the supervision afterwards;and make full use of the results of sampling in order to integrate with the Trade Facilitation Agreement better.
