A Study On The German Family Care Leave System

With the increase in the elderly population and the continuous changes in family structure,the German government has been paying close attention to new family issues and has formulated a series of family-related safeguard policies that are in line with the country's actual conditions.In terms of family security,the government has always advocated a priority policy for family care for the elderly.However,the biggest problem facing family care is that family members may not be able to ensure enough time to care for their relatives due to work reasons,which makes them unable to bear family responsibilities.The family care leave system is a system formulated by the state to intervene in the family field to solve the problem of leaving the work position due to relatives needing care in the family.It also stipulates that taking family care leave is the legal right of workers,and workers can follow the care of their relatives.Need to choose different vacation modes to ensure that family members can get up to 2 years of care leave,and a certain degree of salary or care subsidy can be obtained during the leave,so as to alleviate the economic pressure of the family caused by the leave.After more than ten years of development and improvement,the family care leave system in Germany has a pivotal significance in maintaining family harmony,protecting the rights and interests of the elderly,and building family care services.Most of the elderly care in our country is also family care,and family members have more problems in nursing the elderly and work and employment.Based on this,it is necessary to learn from the experience of Germany to improve my country's pension system and establish a family care leave system.This paper collects a large number of German documents and German laws and regulations on family in Germany,translates them into Chinese,and organizes them into Chinese documents.The important information is sorted out and analyzed,and the relevant content of family is summarized.In addition,on the basis of studying the literature of relevant Chinese systems,combined with comparative analysis methods,comparatively summarized the characteristics of German family care leave,clarified the literal and implicit meaning of the relevant legislative value,and explored the problems of the system and the effectiveness of its implementation.In the future,the legislation of family care leave in our country is proposed.The research of this paper includes five aspects in total: The first part is mainly an overview of family care leave.Based on the clarification of related concepts,it explores the emergence and development of the German family care leave system,and analyzes the legal nature of family care leave in Germany.It is the legal leave rights of workers;the second part focuses on the analysis of the theoretical basis of family care leave in Germany from the theory of state responsibility and family joint theory;the third part analyzes the German family care leave system in detail in terms of applicable subjects of family care leave,the length of leave,occupational security,society insurance and national financial support,and its rights protection system is analyzed from the legislative point of view.Based on the introduction of German family care system through the above three parts,the fourth part focuses on implementation effect,the problems faced,and the reform measures aimed at the problems are evaluated and analyzed;the fifth part is through the study of German family care leave,combined with the inadequacy of the current legal regulations in China,from the two aspects of the value orientation of the legislation and the specific rules to construct family care leave in our country.
