Research On The Dilemma Of Law Enforcement On Illegal Land Use Of Peasant Residence In Yunfu City

Human production and life all need land resources.The State attaches great importance to the management of land and resources,strictly classifies and manages land and resources,cherishes cultivated land to protect arable land,and optimizes the allocation and utilization of land resources to promote economic and social development.The first article of the Land Management Law of the People's Republic of China clearly "protects and develops land resources,makes rational use of land,effectively protects cultivated land and promotes the sustainable development of social economy" Lucid waters and lush mountains are invaluable assets,beautiful rural construction can not be separated from land,,the country is vigorously developing rural revitalization strategy,the first is the need to solve the rural land use problem.At present,the illegal land use of peasant residence has become a hot and difficult problem in Guangdong province,especially in the economically underdeveloped countryside.Yunfu is a mountainous city in Guangdong province,adjacent to the Pearl River Delta,with a large rural population.The illegal land for building houses in rural areas is also the main manifestation of illegal Yunfu in rural areas,which accounts for more than half of the cases of rural land violations.From the angle of land and resources law enforcement,this paper analyzes the existing problems through field investigation,interview and so on,and puts forward the countermeasures and suggestions of land law enforcement.The full text is divided into five parts.The first part of the introduction,to clarify the background of this study and research significance,literature research review,the core concept and theoretical basis and research content,methods and innovation.The second part Yunfu the law enforcement predicament investigation of peasant residential illegal land use problem,through studying the law enforcement data and the case data,carries on the interview method to investigate the peasant House illegal Land law enforcement dilemma.The third part of the reason analysis,according to the results of the investigation,the existence of the government's law enforcement initiative,the insufficient law enforcement deterrent power,the unperfect law enforcement mechanism,the unperfect regulations and the difficult law enforcement environment are five reasons.The fourth part of the countermeasure proposal,combined with the theory of government rule of law,put forward the corresponding problem one by one,including strengthening the government's law enforcement initiative,strengthening the deterrent power of law enforcement,perfecting the law enforcement mechanism,perfecting the regulations and strengthening the construction of the law enforcement environment.The conclusion of Part ?summarizes the law enforcement work of rural residential illegal land use.
