Research On The Medical Security System Of Inmates In China's Prisons

As the executing organ of penalty in our country,according to the relevant provisions of the Criminal Law,the Criminal Procedure Law and the Prison Law,prisons are responsible for the detention and educational transformation of prisoners who have been sentenced by the people's courts to death penalty with a two-year suspension of execution,life imprisonment,fixed-term imprisonment and prisoners whose remaining sentences are more than three months.In recent years,due to the abolition of some death penalty charges in the revised Criminal Law and the careful use of death penalty in judicial practice,the number of long-term prisoners serving sentences in prisons has increased.In addition,the"three categories"of prisoners serving sentences in prisons have been affected by the new Rules for the Implementation of Mitigation and Parole.With the extension of commutation interval and the reduction of commutation range,prisons with full number of original prisoners have become more crowded.At present,China's prison work has steadily improved,and the system has become increasingly perfect,especially for the protection of the rights of prisoners,but with the increase of the number of prisoners,it is bound to have an impact on the protection of the rights of prisoners.For example,medical insurance is one of the basic rights of prisoners who are most concerned by prisoners and the outside world.Although the prison has established a relevant system for the protection of this right and is gradually improving,there is still room for improvement at this stage.Therefore,under the new situation,it is very important to study the medical security system of prisoners in our country.Based on the above background and considerations,this article launches the discussion and the research from the following five aspects.The first part is a general analysis of the medical insurance system for prisoners.This paper defines the relevant concepts of the medical security system for prisoners,analyses the characteristics of the medical security system for prisoners,introduces the evolution of the medical security system for prisoners in China,and expounds the legitimacy of the medical security system for prisoners.The second part is about the medical insurance system and practice of prisoners.Among them,the status quo of prison medical security system includes the status quo of legislation and management system;the current situation of practice mainly takes Fujian prisons as an example,through the basic situation and the main security measures to describe two aspects.The third part is about the problems of medical insurance system for prisoners.It points out that the main problems existing in the medical security system for prisoners include four aspects:lack of laws and regulations,imperfect management system,defective operation mechanism and insufficient supply of supporting conditions.The fourth part is about the causes of the main problems in the medical insurance system for prisoners.The causes include:first,the laws and regulations are not perfect;second,the management system is not practical;third,the operation mechanism is not reasonable;fourth,the investment is insufficientThe fifth part is to improve the medical insurance system and mechanism for prisoners.It puts forward optimization suggestions on four aspects:laws and regulations,management system,operation mechanism and supporting conditions..
