On The Constitutional Protection Of Citizen's Privacy In The Big Data Era

With the advent of the era of big data with cloud computing and cloud storage,people are constantly experiencing the changes brought about by big data.On the one hand,big data has brought new development opportunities to all countries in the world.Through the integration,analysis and prediction of information,he has brought great convenience to people's lives.On the other hand,while people use and enjoy large data services,personal privacy leaks occur frequently,and citizens 'privacy rights are constantly affected by large data:personal privacy information is illegal and excessively collected.External attacks on the Internet and the internal disclosure of personal privacy information have intensified.The trafficking of personal privacy information has become a disaster,and the separation of data from the control of personal information subjects has further deepened.In addition to this,there is also the possibility of being violated by the public power of the state.In this situation,we are even more helpless.The Constitution,as the fundamental law of the country,must have a clear attitude and guidance in this case.From the view of the legal regulation of privacy protection,the constitution of our country does not directly refer to the protection of privacy,but only refers to the relevant content of privacy protection in some articles.The author believes that it is not enough to protect the right to privacy as a civil right,especially in the current special era,big data and Internet times,which brings the strong need for the protection of the right to privacy.It urgently requires that the right to privacy be included in the constitutional protection.The constitutional protection of privacy is the need of comprehensive protection of the right to privacy,the need to prevent the right to privacy from being infringed by public power,and the need to enhance the legal status of the right to privacy.This article aims to explore the current situation and countermeasures of the constitutional protection of the right to privacy in China.It is clear that the right to privacy is a basic human right and should be clearly stipulated in the Constitution.We will improve the constitutional protection of the right to privacy by improving constitutional norms on the right to privacy,enacting relevant laws to protect the right to privacy under the guidance of the Constitution,improving the system of constitutional remedies for the right to privacy,and enhancing the constitutional awareness of the right to privacy.The privacy rights of our citizens are protected in a more comprehensive and three-dimensional way.
