Multi-level direct marketing is a direct selling way for direct selling enterprises to sell products to consumers through the development of multi-level direct selling activities.The research on the construction of Multi-level direct selling system is conducive to the function of Multi-level direct selling system and the healthy development of the direct selling industry in China.This paper will analyze the Multi-level direct selling system from the perspective of civil and commercial law from the perspective of economic law.The main content is divided into four parts:The first part of the article defines the Multi-level marketing:(1)the Multi-level direct selling is defined,and the Multi-level direct selling is only a marketing method,and it is not good or bad in itself.(2)to analysis of multilevel marketing and the related concept,mainly with sheer level direct selling,pyramid to define the difference between a multilevel marketing,think multilevel marketing and MLM has essential difference,does not prohibit multilevel marketing because they like.The second part expounds the advantages of Multi-level organizational structure of direct selling enterprises:(1)saving manpower management cost;(2)expanding the direct selling market;(3)timely grasp market information;(4)reduce the business risks of enterprises.It is believed that these advantages attract the direct selling enterprises to choose Multi-level direct selling mode,and Multi-level direct marketing is the objective requirement of market economy development.The third part content is direct selling:(1)the legal nature of direct marketing personnel legal identity,respectively from the Angle of both China and the outside on the identity of direct sales personnel,think outside the identity of the direct sales personnel can be varied,the cognizance of identity for direct sales personnel in our country is more vague;(2)direct sales personnel related legal relationship,from direct marketing personnel and direct selling enterprises,upper direct sales personnel and the lower direct sales personnel,marketing personnel and consumers to these three aspects elaborates the legal relationship,that between marketing personnel and direct selling enterprises is commissioned by business contract on the basis of the special relationship,upper direct sales personnel and recruitment of the lower is delegated the legal relationship between direct sales personnel,marketing personnel and consumers are buying and selling contract relationship.The fourth part is the key part of the article,the content of the construction of legal system of multilevel marketing of our country:(1)the introduction of outside multilevel marketing system,think our country existing direct marketing system,in which the sheer level of direct selling system of draw lessons from the outside of the multilevel marketing system;(2)the construction of legal system of multilevel marketing of our country,mainly from two aspects of direct selling enterprises and direct sales personnel,mainly from the former market access,calm period,industry association,margin,information disclosure and other aspects,the latter mainly from the perspective of marketing personnel rights and responsibilities,It is believed that the multi-level direct selling system should play its due role under the guidance and regulation of law.
