| The reform of judge post system is an important part of the current judicial reform.Its purpose is to solve the problems in current trial system of China like localization,administration,and ambiguous duties of various types of personnel,so as to promote the professionalization,professionalism,and elitism of judges,thereby realizing judicial fairness and guaranteeing the credibility of China's judiciary.Literally,judge post system contains two aspects,namely how to determine the number of posts and how to select the judges,which are the core content of the post system.The grass-roots courts serve as the main force in handling cases in China,and the majority of cases are disposed at the grassroots court level(according to the statistics issued by the Supreme People's Court of China in 2017,the number of cases concluded by grass-roots courts accounted for 87.94% of the total cases).Therefore,the reform of judge post system at the grassroots level is of particular importance to the overall reform of judicial system of China.To this end,this paper strives to explore the factors influencing judge post system reform and get a glimpse of the current overall reform situation by reviewing grassroots court reform and starting with basic data,with a view to finding out the shortcomings therein and putting forward corresponding countermeasures.Broadly speaking,the reform of judge post system also involves the systems of judge management,security,and withdrawal and even the systems related to trial assistance(such as judge assistant system and court clerk system).These systems containing rich content are closely related to the reform of judge post system,and they together constitute a new trial system.This paper also examines the systems related to trial assistance so as to find out their defections and put forward suggestions.It is expected to make these systems better integrated with judge post system,therebyhelping judges improve the quality and efficiency of trials. |
