| In 2013,China began a new round of judicial system reform,further strengthening the elite and professional construction of judicial team,and improving judicial credibility.Among them,the reform of court personnel system is an important part of this round of judicial system reform.Therefore,the implementation of classified management of court personnel is an important measure to improve the judicial system with Chinese characteristics.The report of the 19th national congress pointed out that we should deepen the comprehensive reform of the judicial system,comprehensively implement the judicial responsibility system,and strive to make the people feel fair and just in every judicial case.In this situation,it is of great significance to vigorously promote the classified management of court personnel,improve the classified management system,effectively realize social fairness and justice,and protect the legitimate interests of the people.Based on the theory of hierarchical management of personnel,the theory of social division of labor,the theory of judicial independence,the theory of hierarchical system and other theories,this paper uses case analysis,comparative analysis,literature analysis and other research methods,combined with the current situation of personnel classification management of Y people ’s Court,summarizes the problems of personnel classification management in specific practice,and draws lessons from the United States,France,Shanghai,Guangzhou East and other places in the court personnel classification management of advanced experience,targeted to improve the countermeasures.At present,the classification management system of court personnel in our country is still affected by the inertia of the traditional management system.There are many problems,such as the double dilemma of court personnel diversion and post adjustment,the difficulty in mobilizing the enthusiasm of trial auxiliary personnel,the number of judges in the court can not meet the post requirements,and the shortage of personnel in the team mode.On the basis of consulting such important materials as civil servant law,organization law of the people’s court,judges law,labor law and opinions on comprehensively deepening the reform of the people’s Court(outline of the fourth five year reform of the people’s court),this paper holds that the path of improving the classified management of court personnel mainly includes the following three aspects:This paper holds that there are three ways to improve the classified management of court personnel:first,to implement and improve the professional security system of judges,especially to improve the identity security system,economic security system,personal safety security system and the implementation of the independent form of examination and approval system of the court;second,to open up a normal promotion channel for the auxiliary judicial personnel,including strengthening The third is to take multiple measures to alleviate the contradiction of"more cases,fewer cases" in the personnel reform,such as accurately measuring the official quota system of the verification method,implementing the judge classification and quota system,placing the appointed but not included judges,and promoting the reform of the trial and judgment operation mechanism. |
