At the Third Plenary Session of the 18 th Central Committee of the Communist Party of China,we deliberated and adopted the decision of the Central Committee of the Communist Party of China on a number of major issues concerning the comprehensive deepening of reform,and made comprehensive arrangements to deepen the reform of the judicial system.The Supreme Court followed up with the fourth five-year reform outline of the People’s Court(2014-2018),which divides the existing court establishment into three categories: Post judges,judicial auxiliaries and judicial administrators.However,as the protagonist of this supporting reform,the public’s attention seems to be focused on the post judges and judicial assistants(judicial assistants),and the judicial administrators ’ attention is relatively low,as a result,some problems of personnel management have not been paid attention to and solved,and the management system needs to be improved.In the daily work of the court,the judicial administrative personnel play a pivotal role.There is a strong need for a professional management organization to handle the day-to-day administration of the court to ensure that judges have sufficient energy to focus on the trial.In the grass-roots courts,there are some problems in the management and management system of judicial administrative personnel,such as unreasonable personnel allocation,imperfect training system,belittling the shaping of professional identity,unreasonable evaluation mechanism,etc..At present,the administrative staff of the basic-level courts include judges with judicial qualifications,judicial assistants who have passed the judicial examination,and non-legal professionals who are specialized in finance,secretarial work and computer maintenance.Before the reform of the post system of judges,on the one hand,they could pass the judicial examination and be transferred to judicial posts with the research and approval of the Party Group of the Court;on the other hand,they could also be selected and selected to serve as middle-level cadres in the various organs of the court,however,following the reform of the post system for judges,post judges had to be selected from among the judges ’assistants,which meant that the path from administrative staff to judges had been completely cut off and that administrative staff could only be involved in the middle-level selection of the integrated administrative services.Their upward mobility is severelylimited.In this context,focusing on the study of the optimization of the administrative personnel management system of the grass-roots courts,and building the professional construction network of the administrative personnel of the grass-roots courts,to realize the effect of court administration has become a new problem to be solved urgently in the judicial reform.Based on the reform of the judicial system and the perspective of human resources,this paper analyzes the construction of the professional management model of the judicial administrative personnel in the grass-roots courts by the methods of observation,Comparative Analysis and Literature Analysis.Taking the current situation of the judicial administrative personnel of the Wenzhou District d court as the sample,combining with the relevant experiences and practices outside the region,this paper analyzes the crux of the existing problems,it is proposed that the administrative personnel management system of the basic-level courts should pay attention to optimizing and promoting the four aspects of personnel allocation,promotion of self-identity,performance appraisal and reward mechanism according to the characteristics of judicial administrative posts,it is referential to the personnel management of the same kind of administrative posts in China.The author intends to make up for the deficiencies of the administrative personnel management and management system in the grass-roots court in the process of judicial system reform.At the same time,it is expected to provide some reference for the construction of the Operability administrative personnel management model with Chinese characteristics,which can be replicated and popularized.
