Research On The Way To Ensure The Implementation Of The Law By Local People's Congresses And Their Standing Committees

With the formation of a socialist legal system with Chinese characteristics as a symbol,the construction of the rule of law in China has been transformed from "having laws to follow" to "having laws to follow",and the focus of the work on the rule of law has gradually shifted from legislation to the implementation of constitutional law.The work of local people's Congresses has also shifted from formulating new laws to paying equal attention to legislation and supervising the implementation of laws.Local people's Congresses,in accordance with the provisions of the Constitution and laws,supervise the implementation of laws by means of case review,law enforcement inspection,post-legislation assessment and reports on the implementation of laws and regulations,and urge law enforcement units to perform their duties.This is an extension of legislative work.It is also the duty of the local people's Congresses to supervise the work as stipulated in the Supervision Law.Local people's Congresses,through their work of legal supervision,have timely knowledge and knowledge of the implementation of laws and regulations,so as to further carry out targeted legislative and supervisory work.From the point of view of local people's Congresses,this paper analyzes and studies the specific path of local people's Congresses to supervise the implementation of the law.The article is divided into four parts,the first chapter,the implementation of the law is summarized.These include: the connotation of law implementation;The necessity and significance of implementing the law are discussed from three aspects: realizing the purpose of legislation,realizing social justice and realizing the rule of law;The main problems existing in the implementation of the current law are studied in depth from the aspects of legislation,law enforcement,and law observance.Reflections on ensuring the effective implementation of laws include improving the quality of legislation,strictly enforcing the law,administering justice impartially,further improving the popularization of laws,and improving the legal supervision system.The second chapter expounds the theoretical basis of local people's Congresses supervising the implementation of the law and their choice of paths,mainly including: the theoretical basis of local people's Congresses supervising the implementation of the law;The practical significance of local people's Congresses supervising the implementation of the law;The local people's Congresses supervise the constitutional basis for the implementation of the law;Local people's Congresses supervise the choice of paths for the implementation of laws,and briefly introduce the basic conditions of the four systems of case review,law enforcement inspection,post-legislative evaluation,and report on the implementation of laws and regulations.The third and fourth parts focus on the four ways in which local people's Congresses supervise the implementation of the law,and further clarify the methods,functions and improvement ways of the four methods of supervision according to the form of classification and comparison.The third chapter,the local people's Congress preparation examination and the law enforcement inspection system and its improvement.The two typical supervisory systems of local people's Congresses,case review and law enforcement inspection,are compared and analyzed.We will improve the review system for local people's Congresses;We will improve the law enforcement inspection system of local people's Congresses.Chapter four,improve the system of post-legislation assessment and law implementation report.This paper analyzes and studies two new types of supervision system of local people's Congresses: post-legislation assessment and law implementation report.We will strengthen and improve the post-legislative evaluation system of local people's Congresses;We will explore ways to establish a system for reporting on the implementation of the law.This paper analyzes the four specific ways of local people's Congresses to supervise the implementation of the law,discusses the characteristics,methods and advantages of local people's Congresses to supervise the implementation of the law,and puts forward specific ideas to further improve the way of supervision,so as to provide reference for local people's Congresses to carry out legal supervision.
