Study On The Protection Of Employment Rights And Interests Of Land-lost Farmers

Achieving the strategy of coordinating urban and rural development,accelerating the pace of urban and rural integration and ensuring the sustainable development of landless farmers are not only an important part of realizing the overall layout of " five-sphere integrated plan " and " four-pronged comprehensive strategy”,but also an important task of building a well-off society in an all-round way.In the process of accelerating urban and rural construction,a large number of farmers have been released from the land and become landless farmers.They are not only contributors to urban construction,but also new vulnerable groups.Land is the basic guarantee for peasants’ survival and development,a valuable family wealth,and employment posts to maintain basic life.Losing land means losing a way of life and development with lower cost than urban life for peasants.Maintaining the employment rights of landless peasants is not only conducive to promoting the employment of landless peasants,but also conducive to regulating the labor market,building a harmonious society and promoting the building of a well-off society in an all-round way.Through the analysis of the data of field investigation and related research results,the current employment situation of landless farmers is very serious.At present,the employment situation of landless peasants generally exists in such situations as poor employment environment,low stability,low wages and insufficient security,which seriously hampers the enthusiasm of landless peasants for employment.The main characteristics of Land-lost peasants’ employment are as follows: firstly,the lack of motivation for land-lost peasants’ employment;secondly,the lack of awareness of protecting their rights;thirdly,the inadequate employment training of land-lost peasants;and fourthly,the lack of vitality of self-employment of land-lost peasants.Based on the investigation of L resettlement community in Shunqing District,Nanchong City,the reasons are summarized from the political,economic,social and legal aspects.The reasons are summarized as follows: the basic system is not perfect,mainly including the shackles of the dual structure of urban and rural areas,the defects of land expropriation compensation system and the imperfect social security system.In terms of employment training,the main problems are the low quality of employment training for landless peasants and insufficient guarantee of training funds.The inadequate work of community employment service is also an important reason for the loss of land farmers’ employment rights and interests.The inadequate employment ability of landless peasants is due to the insufficient accumulation of their own cultural capital and social capital,as well as the limitations of their employment thinking.Laws and regulations are not formulated and popularized in place,which leads to the lack of awareness of protecting the employment rights and interests of landless peasants.In addition,the social security system and rights protection mechanism of landless peasants have not been fully established,and their rights and interests are difficult to be guaranteed.Our country is in a period of rapid change of the times and continuous economic transformation,and the construction of modernization and urbanization is also in a stage of rapid development.In this special period,the employment rights and interests of landless peasants have become a livelihood issue of great concern to the Party and the state.It is an important task for the state to solve as soon as possible.It has also become the focus of public opinion and the focus of academic research by experts and scholars.The government should assume the responsibility of protecting the employment rights and interests of landless peasants.Firstly,we should improve the national system,gradually eliminate the dual system of urban and rural areas,improve the compensation system for land expropriation and the employment security system for landless farmers.Secondly,in order to realize the employment of landless peasants,the most important source is to rely on the development of the national economy to provide adequate employment posts.Furthermore,the most fundamental way to promote the employment of landless peasants is to enhance their employment ability and awareness of protecting their rights and interests.This requires improving the quality of employment training and strengthening the popularization and publicity of legal knowledge.Finally,to further protect the employment rights and interests of landless peasants,it is necessary to actively play the role of community employment service,and strive to sustainable development of landless peasants.
