This article is to cite the phenomenon that our resources are wasted,abused and occupied in pre-hospital emergency medical care,and also to analyze the reasons why the efficiency of using such medical resources is low.The main reason is the imperfect legal system in China: our legislation on emergency medical aids relatively lagging behind;poor legislative quality;not clearing the subject's rights and obligations;lack of uniform specifications on dispatching and who have the final say.Then this paper compared the experience and practice from America,France and UK,indicating they are generally provided the right for dispatchers and medical personnel.To explore the possibilities of us learning from western countries,this paper explains its theoretical basis from two aspects: fairness and efficiency.That means to fully consider demand for individual's medical care reflects fairness,and to decide if patients need urgent medical treatment by pro-hospital emergency medical services ensures proper-and-efficient functioning.Given this understanding,this paper puts forward some legislative suggestions on pre-hospital emergency medical care that include clearing the specific scope and giving medical personnel's right to allocate resources by prioritising between different emergencies,and also choose the right hospital for specific patients.And that will help to enhance the resource utilization and build healthy and sustainable pre-hospital emergency medical system ultimately.
