Empirical Research On Normative Document Filing And Examination System

China's normative document filing system is gradually established and improved with the development of the people's congress system and the state legal system.On July 1,2007,the official supervision law has been officially implemented,and the special seal has detailed provisions on the record review.Since then,the standing committee of the local people's congress has made relevant provisions on the filing and examination of normative documents,and the local record examination system has been gradually established to actively explore and carry out the archival examination.Through the record review of regulatory documents conform to host law judge,is where the constitution,the law gives National People's Congress and its standing committee's important authority at all levels,is an important work of constitutional supervision duties.The regulatory filing system is an indispensable part of the supervision system of local people's congresses and their standing committees.The establishment of the filing system is of great significance to promote the construction of the rule of law government and to improve the system of the people's congress.The record of the standing committee of local people's congress is only 10 years old,the system is not perfect,the theory is not mature enough,there are many problems to be solved urgently.At the same time,the theoretical circle has little research on the regulatory filing system of normative documents,and it is not comprehensive,especially the research on the development and institutional improvement of the record of the standing committee of local people's congress.From the point of practice,the operation mode of the local people's congress(NPC)for the record review,process all have certain differences,there are a lot of laws and regulations have not adjusted the problems,such as the scope of the normative documents,review way lack of initiative,rationality examination standard is difficult to grasp,error correction procedures too much elastic problems such as lack of rigidity.This paper intends to study the system in combination with practice in order to explore more perfect local normative document filing system.This paper is divided into three parts.The first part mainly introduces the development process and legal basis and significance of normative document filing and examination system,and expounds the development process of China's constitution and law.In particular,the new development of China's record examination system after the amendment of the legislation law has fully understood the regulatory filing system and the development process of China's normative documents.The second part starts from the practice of the standing committee of the local people's congress,and compares and analyzes the different practices.The third part starts from the problem,and combines the contents of local regulations of jiangsu province,analyzes the deficiencies of the regulatory filing system of normative documents,and puts forward corresponding Suggestions for improvement.
