Research On Collaborative Mechanism Of Community Correction Subjects

Community correction is a method of execution that is contrary to imprisonment correction.It refers to placing criminals who meet the conditions of community corrections in specified community.The special state sectors,with the assistance of relevant social groups and civil organizations and social volunteers,within the time of judgement,determination or decision,help the criminals to correct their psychology and behavioral habits,and return to society smoothly by non-custodial execution activities.Community correction activities involve government sectors of judicial,public security,courts,procuratorates,civil affairs,social security and so on,and social forces such as social organizations and volunteers Because of the diversity and complexity of community correction objects and the natural barriers between each other,there are many problems in practice due to the lack of perfect coordination mechanisms,such as difficult to implement remote corrections,different departments shirking responsibility and not obvious correction effect.Luohu District of Shenzhen City,as one of the first pilots in community correction in China,after more than ten years of accumulation and precipitation,has been gradually meeting these problems.What's the specific performance of these problems?How do we know about the causes and solve them?All of these worth studying and are the main content of this articleThis paper mainly uses literature analysis method,case analysis method,in-depth interview method and other methods to study the collaborative mechanism of community correction subjects,collects and refines the representative and widely used theories and viewpoints on community correction mechanism,and analyse the work summary,successful experience,existing problems and so on that are related to the community correction mechanism of Luohu District in depth,and make in-depth interviews with different levels of government departments of the Public Security and Inspection Department of Shenzhen,as well as staff of active social organizations.These can help understanding how the community correction subjects know about the status of problems and causes of the collaboration mechanism.At the same time,using the theory of Collaborative Government,from the three dimensions of intergovernmental,inter-departmental,government and social,with comprehensive analysis of related issues,and combined with the core ideas of the theory,we can propose some countermeasuresThrough research and analysis,this paper summarizes the following problems in the community correction mechanism of Luohu District,Shenzhen,and analyses the reasons Firstly,the problem of inter-governmental cooperation mechanism is manifested in the lack of unified work standards,applicable guidelines for remote correction and substantive data docking between different provincial and city governments.Secondly,the problem of inter-departmental coordination mechanisms is manifested in the fact that the core status of the competent authorities is not prominent and the community corrections are eligible Cognitive differences and work regulations are different.The main reasons are departmental interest conflicts and lack of long-term mechanisms and legal guarantees.Thirdly,the problem of cooperation between government and society is manifested in the failure of information technology to meet management needs and social forces not playing full roles,mainly due to the imperfect construction of the information management platform and the imperfect participation mechanism of social forces.On the basis of clarifying the problems,learning the successful experience of developed countries in the community corrections cooperation mechanism,this paper makes recommendations of implementation of inter-governmental regional cooperation,strengthening the cooperation between the judicial administrative agencies and government departments,and increasing the collaboration between government and society.
