| Since 2015,courts all over China have carried out the practice of online filing.However,due to regional differences,there are great differences in the construction status of online filing platform and operation rules.While improving the efficiency of filing cases and increasing the judicial transparency of the people' s court,it reduces the filing costs of the parties and facilitates the efficient exercise of the right to sue.Online filing has made a lot of achievements,but there are also many problems and drawbacks,which lead to its poor operation and deviate from the judicial reality.In order to solve the problems of online filing,this paper puts forward some suggestions to solve the problems of online filing.In addition to the introduction and conclusion,this paper is divided into four chaptersThe first chapter is empirical analysis,through exploring the practice of online filing in various places,analyzing the construction of online filing system.When using the online filing system,the judicial practice problems caused by different operating rules in different places can be intuitively understood.The second chapter analyzes the function of online filing,and expounds the role of online filing in facilitating litigation from two aspects:facilitating the efficient filing of cases by the people' s court and the protection of litigants' right to sue.The third chapter demonstrates the difficulties faced by the online filing in the process of practice,mainly for the system dilemma and practical dilemma,and analyzes the deep-seated reasons for the various dilemmas of online filing.Among them,the most important one is the lack of unified legal basis,which leads to many problems,such as the conflict of opinions in different regions,how to locate the online filing,and the legal basis On the other hand,the lack of the lack of practice has led to the production of practical difficulties,which does not reflect the value of benefits,and the lack of security of filing information,which are all urgent problems to be solved in judicial practice.The fourth chapter puts forward a series of strategies to promote the effective operation of online filing through the practical situation and functional analysis of online filing.The most important thing is to establish a unified and clear legal basis,gradually solve various problems arising from the use of online filing system,strengthen auxiliary functions,and make it run smoothly,truly facilitating the parties and the people's court To make full use of the benefit value. |
