Discussion On Cybersafety And The Perfection Of Cyberspace Security Legislation

With the rapid development of information technology,Cyberspace Security becomes more and more important.To ensure the cyberspace safety,The Cybersecurity Law of the People's Republic of China was adopted.However,the definition of cybersecurity is to protect network security and network information security,in the content,it also includes the protection of personal information,illegal information management and cross-border data flows three elements.That means,the definition is not Correspond with the specific provisions in China's Cybersecurity Law.This paper is based on ISO/IEC 27032:2012.First,the exact meaning of safety and security and the difference and connection between them are cleared;based on the meaning and the associated with explicit safety and security,with ISO/IEC 27032:2012 as the angle of view,to clarify the Cybersafety and Cybersecurity,and distinguish between Cybersafety and information security,application security,network security,Internet security,critical information infrastructure protection(CIIP),to help the readers know the exact meaning and the differences in basic terms of Cyberspace Security;finally,through the analysis of domestic and foreign cyberspace security legislation,focusing on The Cybersecurity Law of the People's Republic of China,demonstrate that the introduction of Cybersafety in China's cyberspace security legislation plays a certain reference role for the improvement of Cybersecurity Law.
