Research On Government Regulation Of Labor Dispatch In Shanghai

As a new mode of employment,labor dispatch has been recognized by more and more markets in the development.The new "labor contract law" was revised in 2008 and 2012,which specifically introduces the relevant content of labor dispatch in detail,and provides for the implementation and improvement of this system from the legal level,which is conducive to the development and improvement of labor dispatch system in China.So far,the labor dispatch system has been widely used in most enterprises in Shanghai.Even in some public institutions and government agencies,labor dispatch mode is gradually adopted.As a new employment mode,labor dispatch mode distinguishes the employment from the use of labor.Therefore,according to China's traditional labor security related legal system,are unable to labor dispatch legal interpretation.At the same time,these years,the rapid development of labor dispatch mode is affected by many factors.For example,from the human level,the per capita production labor force is constantly rising,which specifically involves that there is no fixed term,but there are labor contracts to avoid.In the regulation of labor dispatch,the government element is introduced,in which the government mainly plays the role of standard guidance.The government should avoid all kinds of social conflicts caused by labor dispatch in a timely manner,stabilize the market development order,and thus protect the legitimate rights and interests of consumers.In this paper,we take Shanghai as an example to introduce and analyze the current situation,shortcomings and development Suggestions of labor dispatch system in Shanghai.This paper is divided into the following seven parts.The first chapter is the introduction.This paper introduces the research background,research significance and research methods of this paper.The second chapter is an overview of relevant theories.The paper mainly introduces labor dispatch and related theories.Chapter three introduces the relationship between government regulation and labor dispatchand the existing problems in the development.Chapter four analyzes the deficiencies of government regulation in labor dispatch and the causes of these problems.Chapter five introduces the development experience of other countries in the regulation of labor dispatching government.The sixth chapter,combined with the actual situation of Shanghai,puts forward countermeasures and Suggestions for further promoting government regulation in local labor dispatch.The seventh chapter is the conclusion.
