Labor dispatch originated in the United States in the 1920s,it is a special form of employment.Since the end of 1970s,labor dispatch began to appear in China.Since the 1990s,labor dispatch has developed rapidly,and it has been involved in many industries such as banking,telecommunications,housekeeping,hospital,postal service and construction.Due to the particularity of labor dispatch as an employment form,various problems have appeared in the process of rapid development of labor dispatch,and the government has conducted certain guidance and standardization for it.However,in the process of the government's management and regulation of labor dispatch,there are many problems.How to further improve the government management efficiency of labor dispatch,to protect the legitimate rights and interests of dispatched workers,and ensure the sustainable and healthy development of the labor dispatching industry,is an urgent problem to be solved in front of relevant government department.Firstly,this paper summarized the practices and relevant literature research on labor dispatch and government management at home and abroad,analyzed the core concepts and related theories,investigated the status of labor dispatch and government management in Shandong province through questionnaires and interviews.And on that basis,it analyzed three major problems:the imperfect market access and withdrawal mechanism of labor dispatch,the difficulty in protecting the legitimate rights and interests of dispatched workers,and the imperfect supervision and management system of labor dispatch.Then it analyzed four deep-seated reasons:the legislation regulation of labor dispatch is relatively lagging behind,the relevant laws and regulations of labor dispatch are not enough,the government's supervision function of labor dispatch is very limited,and the management of labor dispatch is lack of the third-party mechanism.Finally,this paper putted forward countermeasures and suggestions to optimize the government management of labor dispatch.First,optimize and improve the market access and exit mechanism of labor dispatch,including raise the market access threshold of labor dispatching industry,adjust the period of business license for labor dispatch,establish and improve the market exit mechanism of labor dispatch;Second,refine and improve the laws and regulations of labor dispatch,including specify the applicable scope of labor dispatch,improve restrictions on the time limit for labor dispatch,detail punishment for illegal ACTS of labor dispatch,define the division of legal responsibilities between labor dispatch service providers and employers,define the definition of "equal pay for equal work" for labor dispatch,and define the difference between labor dispatch and labor outsource;Third,strengthen the supervision function of the government on labor dispatch,including strengthen routine supervision,innovate and enrich supervision methods,and strengthen supervision and law enforcement;Fourth,efforts should be made to build a coordinated management system for the labor dispatching industry,including guide and standardize the behavior of the three parties in labor dispatch,stimulate the role of trade unions in labor dispatch,and encourage the development of labor dispatching industry association.
