Legal Problems And Countermeasures Of Sino-russian Railway Cargo Transport Cooperation

Sino-Russian cooperation is one of the most promising areas of foreign policy in both countries.This paper discusses key aspects of legal problems in railway cargo transport cooperation.Cooperation on the railway is one of the main directions today,especially in the framework of the “One Belt – One Road”,“Europe – China” projects,as well as within the SCO,etc.The study revealed that,despite the number of ongoing projects,there are a number of problems that complicate the development of cooperation on this issue.Thus,legal problems may pose a strategic,economic,military and political threat to cooperation between Russia and China.An analysis of the rather scanty international legal base of Sino-Russian railway relations suggests the conclusion that there is no distinct railway policy between the states.Therefore,the legal provisions governing cross-border cargo flows between countries should respect the interests of all parties and eliminate possible holes in the law.In order to effectively address existing problems,it is proposed to explore the experience of other countries,namely the countries of the European Union,on this issue.This is done in order to,after analysing their actions,find more effective ways to solve various tasks without making serious mistakes,adapt them to the specifics of the region.In conclusion,the proposed solutions to previously identified legal problems in the field of freight rail transport:adoption of data protection laws at the national level of each state;the creation of independent control bodies at the international level,under whose control freight forwarding companies will be created,and a new form of train control and a separately developed document form for carriers will be created;also at the international level it is worthwhile to work out a uniform tariff system;special attention should be paid to already sign agreements between countries,since the development of the world is not in place and technologies are improved every day,then some requirements and measures in the agreements are outdated by today's standards.These measures will allow harmonizing and improving the already existing system of international agreements,treaties,and laws.
