Research On The Conversion System Of Foreigners' Residence Status In China

The current trend of world globalization will inevitably bring about the internationalization of the flow of people,which is an irresistible historical trend.At the same time,the demand for the free flow of international personnel under the conditions of globalization has put forward higher requirements for the domestic legal systems of various countries,especially for the resident status conversion system for foreigners.In China,this problem is becoming more and more obvious with the deepening of reform and opening up.With the increasing number of foreigners in China,the relationship between them and China's economic and social development is becoming closer and closer.At the same time,due to the imperfection of the resident status conversion system for foreigners,the effective management of foreigners and the exchange of foreign personnel in the social economy are limited to a certain extent.The "three non" problems of illegal entry,illegal employment and illegal residence of foreigners are also being highlighted.Therefore,it is of great significance to construct a reasonable system for the transformation of aliens' residence status,not only for the development of China's social economy,but also for solving some difficult problems in the management of aliens.This paper mainly reviews the process of the continuous improvement of the system of aliens' identity conversion since China's reform and opening up,combs and analyzes the relevant provisions on the system of aliens' residence status conversion in China's legislation,points out some deficiencies in the system of legislation,and points out the areas that need to be improved in the law enforcement.At the same time,referring to some successful international practices on the conversion of resident status of foreigners,combined with the analysis of China's situation,especially on the existing problems of the conversion system of resident status of foreigners in China put forward some improvement methods.It is hoped that by drawing lessons from the current immigration system,some of the national systems will be perfected.One is the way to properly open the resident status of short-term work to eligible foreigners in the special areas of border provinces.The other is to properly open the way to change the resident status of foreign students to the resident status of work.Thirdly,it is necessary to relax the conditions for the transformation of the resident status of foreigners into permanent resident status and permanent resident status.Fourthly,it is necessary to stipulate the methods of integral naturalization and quota system,and to appropriately liberalize the ways for permanent resident status to join Chinese nationality,so as to realize the refinement and classification of the system for the transformation of resident status of foreigners.At the same time,this paper also puts forward some beneficial measures for the improvement of the system in dealing with the increasingly serious problem of "three non-nationalities" of foreigners.It also discusses the problem of how to transform the residence status of foreigners into Chinese nationality,which has not yet been perfected,and provides a reference method and train of thought.That has a good reference for the corresponding system improvement and judicial practice.
